Herlihy made a strong plea to Justice Scott in the Criminal Branch of the Supreme Court to-day whon Assistant District-Attorney Rand moved for the retrial of the cap- tain on May 4 for neglect of duty in the “Red Light" district. Herlihy advanced to the bar alone, recited the story of his previous trials on the same charge, and added: “I have spent all the money I had saved In my own defense, and I am now not only without funds but in debt to my lawyers. I am living on money borrowed from friends. “Under the rules of the Police Depart- ment 1 am compelled while under sus- pension to report twice a day for duty and cannot engage in any business.
