WX WIPED OUT. feree Gilbert M. Speir Re- ports that the Extra Assess- ment of Personal Property for 1900 Was Irregular. D NOT ALLOW FOR DEBTS. Speir Says that the Indebtedn of the Company Exceeded the As- Gessable Value of Its Personal Property In January 2 Years Ago. Gilbert M. Speir's report as referee in tthe certtorar! proceedings brought by the Metropolitan Street Rallway Com- pany for a reduction of the assessment on personal property by the City Tax! Commissioners in 1900 says the whole| ‘assessment was irregular. The original figure was $45,000,000, but this was reduced after a protest from the company to $10,421,789. Referee Bpeli's findings wipe out even this, and {f his report 1s confirmed the Metropol- Itan need not pay a dollar of personal taxcs for 1900, The conclusion that the assessment wan {Ileal Is based on Mr, Speir's find- fing that on the day of assessment, in Jianuary, 1900. the capital stock of the company had no assessable or taxable value. In this case, as in that of the Twenty- third Street Raflway Company, {t was claimed that the debts of the company exceeded the value of personal property ‘or capita! stock. Mr. Spels was referee in the latter case. An amount of $1,500,- 000 was reduced on the company's pro- test to $200,000, and certiorari proceedings ‘were taken against even the smaller fig- ure. Referee Speis reported wiping It all out. Asststant Corporation Counsel David Rumeey represented the Tax Commis- sioner and ex-Supreme Court Justice darles F. Brown appeared for the com- panies.
