Justice Steckler, In the Supreme Court to-day, handed down a decision hold- ing that an attorney ts entitled to com- pensation for services rendered in a suit for the foreclosure of a mortgage where the mortgagee dies before judgment has been entered and where hin executrix de- clines to avail herself of the services of her husband's attorney. Busse, as executrix of Wilhelm Busse, her deceased pusband. % Skinner was retained by Busse on Aug. 4, 1809, to bring forectosure suits for $10,260 due on two pleces of property. Skinner was to receive as compensation the costs, disbursements and allowances as taxed if the property was bought by an outsider and a feo equal to these amounts should {t be bought by the mortgagee. Skinner began the actions and proceeded with them until Busse was entitled to judgment Busse died in November, 1900, and Skinner desired to continue the suits, but Mrs. Busse inaisted on retaining an- other lawyer, The properties were sold and a deficiency judgment entered tn each case. Skinner claimed he had a lien on Mra. Busse'g two causes of ac- tion for the services rendered by him. Mrs, Busse declined to pay, and al- leged that as the property was bought in by her as executrix and was held by her for phe creditors, legatees and bene- flolaries of her husband's will as per- sonality, and that Skinner could not en- force his claim as lien, his remedy being an action at law.
