Judge Brown, of the Supreme Court, filed with the Clerk of the Kings County Court this morning his decision on the Collins Sunday Barber law, carried up on a writ of habeas corpus by ex-Judge GBteckler, of New York, on behalf of @amuel Hobach, a Brooklyn barber, who made a test case by persisting in Going business on Sunday, June 9, on the ground that the new statute was unconstitutional, because it exempted New York City and Saratoga, where barbers may perform work until 1 @olock P. M. This decision will dispose of the test @ase now before the courts here, in which a New York barber sought to have the law set aside so barbers may keep open all day instead of closing at 1 o'clock P. M. on Sundays. Judge Brown in concluding his ar- gument on the pleas of council for Hobach says: “That the Legislature only prohibits all work on Sundays {8 conceded and this concession disposes of the case, as there is no constitutional restriction upon its powers to enact a law applica- dle only to a part of the State. “I have examined carefully the cases eited from other Btate reports by the some of them Felate to local municipal ordinances, others relate to general restrictions “* Upon the pursuit of business or profes- sion.
