The trolley railroad companies of Brooklyn have begun their fight in the courts to defeat the law by having the speed and fender ordinances declared to be unccnstitutional, Several days ago Assistant Corpora- tion Counsel Angell began suits against. the Brooklyn Heights Railroad Com- pany, Atlantic Avenue Railroad Com-| pany und the Brooklyn City and New- town Railroad Company to recover $25, the penalty imposed by the ordinance, for operating their cars in exc: of the legal rate of speed. The suits were brought in Justice Neu's Civil Court in City Hall and were set down for trial to-day. Mr. Angell was ready to go to trial at once, but the railroad attorneys ob- Jected. They filed answers to the com- plaints and asked for an adjournment. Justice Neu said he would try the cases on July 15. ‘The specific charge against the Brook- lyn Heights Railroad Company 1s that on June 18, It operated a care on the Gates avenue line, and Bushwick avenue, at the rate of twelve and two-tenths miles an hour; against the Atlantic Avenue Railroad Company, It is alleged that on June 20 ‘the company operated a Seventh avgnue car on Adams street, between Concord and Tillary streets, at the rate of twelve miles an hour, The Brooklyn City and Newtown Railroad Company Is* accused ef sending one of its cars over Frank- ~-f avenue, between Prospect and Park Places, on June 20, at the rate of thirteen and nine-tenths miles an hour. The Atlantic Avenue Rallroad Com- pany in its answer adinits that the Common Council of the City of Brook- lyn {s duly authorized to enact such reasonable ordinances for the govern- ment of Brooklyn as are specifically provided for b¥ the charter. In paragraph Il. of the answer the Company admits that the Common Council on March 25 adopted an ordi- nance, and ‘thereby attempted to regu- late the speed and the mode of use of the tracks of its road, and that the ordinance was amended on April 1, but ft denies tha. tne ordinance {s now, or at the time of the alleged offense was, in full force and effect.
