HUNDREDS OF TROLLEY SUITS Wholesale’ Violations of the Life-Saving Fender Law to Be Prosecuted. FINE OF$25 FOR EACH OFFENSE The Ordinance Does Not Make Any Provision for Orim- inal Actions. CANNOT SEIZE CARS BY FORCE. May Ask for an Injunction Hereafter to Restrain the Companies from Operating Line: Corporation Counsel McDonald, of Brooklyn, announced to-day that sev- eral hundred suits would ba begun in behalf of the city against the various trolley railroad companies to recover $35, the amount fixed for each violation of the city ordinance, which took ef- fect yesterday, and which requires the companies to equip their cars with life: waving fenders that extend within three inches of the ground. Mr. McDonald said Chief Trolley In- spector Franklin and his fifteen assist- ants had been sent to Fulton Ferry and other pleces this morning, to secure evi- @ence of the wholesale violation of the law. Mr. McDonald also sald that blank forms of complaints had been ent to the printer, with instructions to rush the work. The sults will be brought in the justices’ courts. “Will anys.oriminal action be taken against the managers of the rallroads?* he was asked. “Not just at present, In fact, we do not see how we can, as the ordinance does not prescribe any punishment be- yond the fine alluded to, “Our inspectors," continued Mr. Me- Donald, “have been instructed to take the number of every car being operated without a fender, and when any device fe attached ‘to the platforms, they are to measure the dimtance between it and the ground.’ “Do you contemplate following the ad- vice of a lawyer printed in ‘The World’ to-day, who suggests that the companies might be reached if the city seized some of their cars on the ground that they ‘were public nuisances: ‘Allour movements in this matter must ‘be according to law, There is no au- ‘hority with which I am acquainted by which we could go in and seize a rafl- road company’s rolling stock.” “How about asking the Supreme Court for an injunction to restrain the com- pantes from operating their cars unless they comply with the law by putting fenders on their cars?” “That has been under discussion, We think, however, that as the valldity of the ordinance is being attacked it would be betic: to bring these suits to recover the amount of the fine. If the ordinance e upheld, amd we recever the penalty, will then be possible to Ko into court o if the companies fail THE SEVENTH IN CAMP. Gev, Mortem Will Visit the Boys ‘To-Morrow.
