HOEBER WILL ARREST TAMSEN. lf the Sheriff Is Found Gullty of Contempt It Will Give the Coroner “ Great Pleasure.” Justice Barrett to-day issued the fol- lowing order in the matter of the pro- ceedings to punish Sheriff Tamsen for contempt: “On the proceedings relating to the coffimitment in the case of the People of the State of New York against William ‘W. McLaughlin, underindictment for bri- bery and extortion, and on the affidavit hereto annexed, let Edward G. H. Tam- sen, Sheriff of the city and county of New York, and John Illingworth, ® prison guard, appointed by said Sheriff, «stow cause before me on May 15 18%, at 11 A. M., in the Court of Oyer and Terminer, why the eaid Edward J. H. Tamsen and said John Iilingworth should not be punished as and for contempt of Court in that they wilfully disobeyed a process of this Court and violated the terms of its commitment in not delivering the body of William W. McLaughlin to the care and custody of the Warden of the City Prison as they were directed to do, This order, together with a copy of the commitment and a copy of Clerk Carroll's affidavit and copies of the af™fi- davits of Daniel J. Kelly, Deputy Sher- iff, and Prison Keepers Bernard McGill and Frank Smith, was served on Sher- iff Tamsen and Deputy Sheriff Illing- worth to-day. , Assistant District-Attorney McIntyre ald in relation to the order that if Tamsen could purge himse:t of contempt to-morrow, then he woutd at once pro- ceed to take action against the Under Sheriff, Sherman, and see that he was punished in Tamsen’s place. If Tamsen cannot purge himself from the contempt, then he will be punished and Sherman may go free. McIntyre's plans go through all right, and there is jo reason, so far as he can see, why they should not. “I am going to lay before Justice Bar- ett to-day the fact that Under Sheriff H. H. Sherman is, in my opinion, the responsible party for not having In- @pector McLaughlin locked up," sald Mr, McIntyre this morning. “If Sheriff Tamsen can show clearly and plain!y that he was out of this coun- ty upon business which precluded the possiblilty of his presence here, why, 1 suppose we must accept his explana- tion, but that does not let out Under Sheriff Bherman, “He was the Acting Sheriff of this county at the close of the McLaughlin trial, and he is responsible for the acts of his deputies. “On the last day of the trial, Mc- Laughlin was under the charge of Dep- uty Sheriff Kelly, a good and tried man, who for years has performed his duty without fear or favor, and who was perfectly competent to attend to his duty in relation to McLaughlin, Why Was Kelly Supplantedt “If Kelly had been left in charge of McLaughlin, he would have locked the Inspector up in the Tombs, as the Court directed, but Kelly was relieved, and Alingworth put in his place. “[ilingworth went to Kelly in the eourt-room and sald: “I am to take charge of McLaughlin now; you are relieved.’ “Kelly went to Clerk Carroll and told him that Illingworth had been sent to relieve him, “1 don't know Illingworth,’ sald Mr, Carroll, ‘Why has he been sent here in your place?” “Kelly could give no answer to this, but he introduced Illingworth to Mr, Carroll and went back to the Sherift's office. “The man who was directly responsible for the r+moval of Kelly and the putting of Ilingworth tn his piace, was Under Bherlff Sherman, To-day I wil lay the facts before Justice Barrett and will ask him if in his judgment I should prefer charges against the Under Sheriff. “If he thinks it best not to do so be- fore him, then I will go before the Grand Jury to-morrow and will have Sherman indicted for wilful neglect of duty.” “Sherman, by the Way, was the coun- gel for the Committee of the German- American Reform Union who preferred charges against the District-Attorney's office last December and tried to get tue Governor to remove Col. Patrolmen Alexander Kerr, of the West Sixty-eighth street station, and Charles H, Snyder, of the East One Hundred and Twenty-sixth street sta- tion, both accused of brutal assavit on citizens, will be tried by the Com- missionerg on complaints filed to-day by Inspector Conlin. Last Thursday night Uriel Gunthorpe, @ colored man, claims that he was standing at Sixty-first street and Am- sterdam avenue. when Kerr came up and struck him without provocation, then forcibly shoved him up the street and kicked him in the back. Kerr denies the charge. While on the way home last Saturday night Jeremiah Harrington, a shoo- maker, of 179 Third avenue, says he stumbied over a box in front of a store at Third avenue and One Hundred and Seventeenth street. He asked Policeman Snyder who left the box on the etree! “It's none of your —— business,” Har- rington says Snyder answered, and when he remonstrated the policeman, he says, struck him in the face three times with’ his fist. Snyder also denies this charge against him. MAY INDICT BIG MEN. The State-Honse Frauds Left with @ Grand Jury. TRENTON, May 14.—Justice Gummere charged the Mercer County Grand Jury in the Court-House to-day. He called attention to the fact that no one was too great to be indicted, and charged that the State House officials should be Investigated. He said charges were al- leged against some of them, which if found to be true, should cause the Grand Jury to find an indictment against the officials accused. He analyzed the law on the purchase of the supplies for the State, and sald that the exorbitant prices paid for articles constituted fraud. Justice Gummere said that another ation of the law was presenting false bills to the State for payment on the purchase of lumber, furniture, coal and the like, The Judge stated that In one case a State officer is allegel to have offended in this matter. He charges againgt bidders for State printing, buy- ing off competing rivals, and said he was also informed that ‘many witnesses re falsely before the Voorhees In- vestigating Committee.
