New- ton Whitehead, has tetained as his counsel George F. Elliott, who ts couttsal for the Law, Enforcement Soclety of Brooklyn, which is closely allied to Dr. Parkhurat's Soctety, ‘The retention of Mr. Elitott has given rise to rumors that Frink will turn State's evidence against Sergt. O'Toole, who ts Indicted on tne same charge, and that he has made a confession which will be used by the Parkhurst Society to try and have higher police of- ficials Indicted. In the Court of Oyer and Terminer to-day, District-Attorney Fellows gave notice that on Wednesday he would move the trial of Sergt. O'Toole and Detective Frink. “These cases," sald he, “were trans- ferred from this court to the Court of General Sessions, but I have this day transferred them back again. Justice Barrett sald he ‘wished to ow whether the District-Attorney was sure that the cases could be begun Wednesday next. Col. Fellows said that he belleved that they could be, but that he would communicate with the lawyers for O'Toole and Frink and find out.
