POLICE JUSTICE QUIGLEY IS OUT, Sympathized Too Much with Trolley Strikers Brought Before Aim. SHIRKING. OF DUTY FOUND, Brooklyn General Term Says a Succession of Cases Leaves No Doubt. CASE CANNOT BE APPEALED. Quigley’s Friends Say He Does Not Care Enough for the Office to Try to Get It Back. The General Term of the Supreme Court, Brookiyn, at 11.30 to-day returned an oral decisin removing Police Justice James F. Quigley, of the Gates Avenue Court, Brooklyn, for the intentional vio- lation of his official duty in the disposl. tion of cases connected with the recent trolley strike. The charres against Quigley were brought by Mayor Schieren as Mayor, and as 9 taxpayer. The trial lasted three days, ending last night. The court-room was crowded this morning with the friends of Justice Quigley and others interested. Justice Brown rendered the opinion. ‘The Judge said in substance: “When the Court handed down its @ecision in the Watson case, It stated the rule which should be applied, The Court thinks the same rule should ob- iain in this case; that the evidence must ie corruption, intentional violation ef duty, disregard of law, conclusions and Wiitur disregard of egal rule ‘Applying this rule in the Watson gare, we found the evidence Insufmcient, he ‘Court found one of two cases de serving censure, but lacking an inte tional violation, In applying the sami Tule to this case the Court arrives at a different_conclusion. “The Court stili adheres to the rule that a magistrate should not be removed because the General Term disagrees with him. It made no difference in this case whether It struck a voman or a man, The officer Was taken to task, The case against the prisoner was dismissed. “In the Connolly case a car was as- saulted and a motormnan was threat- ened with violence. The magistrate did rot believe Connolly, ‘The case was dis- missed. “In the Mullin case there was no doubt that a motorman was taken from a car to Palmetto Hall and there In- Umidated. There was no doubt that Mullin was in the hall, because he was arrested there in spite of the fact that three witnesses swore that he was not there. There seems to have been no ex- cuse whatever in that case why the pris- oner shculd rot have been held for the Grand Jury. “We find some of the Judge's remarks to have been improper. They were re- marks which te to encouraze evil | doers, He said in court that the strikers had a right to get men off the cars, but they must do so peacefully and orderly.
