LOSH WASHINGTON, May 10.—The fed- | eral government has been virtually | WAN eliminated ‘as the public's defender against higher sugar prices and the sole defense against a continued boost ix the housewives’ boycott, of- fidials frankly stated today. The government's drive to end the increase was checked yesterday when the New York federal court dented its application for, an injunction re- straining the New York. sugar ex- change from creating artificially high prices by trading in sugar fu- tures. Tho the government will appeal to he supreme court immediately, no hope may be expected from that quarter, even in the event of a fa- vorable decision, officials declared, because of the virtual certainty that the court will not hand down its final decision in the case until some time after next October. Unable to prove a violation of a civil statute to the satisfaction of four federal judges, the government has no grounds on which to base criminal action, it was admitted. When the beet sugar crop arrives in September the speculators’ day will be over, officials pointed out, prices will probably return to nor- mal and even a favorable decision of the supreme court on the govern- ment’s appeal will be of no vital im- portance, other than establishing a precedent for use against future gouge attempts. The department of justice today |N prepared to expedite the supreme court action on its appeal by every expedient possible.
