Last Mbonday a postponement to to-day was ordered on account of thé illness of Juror D. M. Cox. This morning Jurors L. H. Plate’and J. H. Allen stated they had visited Cox and éxpresged the belief that 1t would be a long time before he would ba able to re-enter the jury box, if ever. . Judge Hart asked.if the attorneys wer utllnod with the statements of Plate and Allen and would acceot them in the -absence of a physician’s certificate as to Cox’s condition. Both .s{des announced their acceptance of the statements made. Judge. Hart then made an order dis- charging Cox’ from further duty, which was followed by. a discussion as to what course should he pursued. Frank D. Ryan of counsel for the defense was in, but District Attorney Seymour would noty consent and stood upon the law, be drawn in-such cases. Charles T.
