The harbor officials get ten days in which to answer the com- plaint. | The litigation arose vver the action | of the Harbor Board in revoking the ! permits of Schultz, Hanson & Co., G. B. | Olcese Company, Jonas, Erlanger, Da- ! vis Company and Webster & Dunbar. | The firms were charged with violating | the Woodward act and a rule of the board providing that the dealers, on | demand, should sell potatoes in ten- | | of the Smoking Jacket Here s where we turn loose some of the verv smartest, handsomest and lat- est designs in Jack- ets in the Double- Tone Cloths in the most swagger shades—Jackets that you will not find their equal in tawn at $2.50, which we specially price, be- ginning Monday, at $5.00 In addition to this Special, we are showing some grand things in Jackets— entirely new and novel ideas, at.$7.50, $8.50, $10.00, $12.00, ) $1500 and up to $50.00. sack lots and onions in five-sack lots. | The dealers entered intc an agreement in writing to buy and sell in not less | than fifty-sack lots of potatoes and | twenty-five-sack lots of onions. | Judge Sloss held that the agreement | between the dealers provided that | smaller lots might be sold at propor- | tionately higher prices and therefcre it | only fixed a minimum lot to which | wholesale prices would apply and was | not in violation of the Woodward law. It would be an unreasonable construc- | | tion of the law, he said, tc hold that it | | imposes on dealers who hold permits to trade on the wharves a duty to sel at retail as low as they sell at whole- | | sale. On the face of the complaint, said the court, the charge against the deal- | ers did not constitute a violation of the | terms of the permit and furnished no | Justification for revocation of the per- : mits. In dealing with the question of the injunction, Judge Sloss found that there were other considerations. The affidavit of John M. Foy, secretary of | the board, set forth that the dealers had been accused of entering into a | conspiracy and the accusation did not | refer to the agreement which the plain- | tiffs offered in court, relating to lots | and prices. The accusation was only ! that the dealers had agreed not to buy | from or sell to certain parties in less | than fifty and twenty-five sack lots. | This charge was heard by the board | and determined adversely to the deal- | ers and their permits were revoked. In | the absence of any claim that the board | had acted fraudulently, capriciously or | arbitrarily, the court would not con- | sider the evidence before the board on | that hearing. The permits were re- | voked on the charge that the Wood- | ward act had been violated and there ! was no ground for an injunction. ’ —————— { | | | | | Oricntal Designs In Robes Beginning Monday we will sell the: $10.00 grade at.... $7.00 $15.00 grade at....$9.00 $20.00 grade at... $12.50 These represent the smartest things of the season.
