OPPOSES SALE OF RANCH OWNED BY DUTARD ESTATE Attorney Says Recent Oil Develop- ments Have Enhanced Value of the Property. ‘Whether a ranch in Santa Barbara owned by the estate of the lat> Hippolite Dutard, the produce dealer who died in 1900, shall be sold to satisfy a mortgage held by a local bank is the basis of the latest litigation over the Du- tard estate. Mrs. Eliza widow of the deceased, wants to sell it. but Kieinclaus and Leonce Dutard, a sister and a brother of the deceased, oppose the sale. The guestion of sale came up yesterday in the Probate Court on petition for distribution of that part of the estate flled by the widow. The matter was argued at length by Attorney William Rix for the petitioner and C. J. Heggerty, attorney for the opposition. The matter was continued un- til Friday afterncon, when the merits of the case will be gome into. The widow wants to gell the ranch for $300.000, which is almost five times the appraised value of the land. Heggerty opposes the sale on behalf of his clients on the ground that because of the re- cent discovery of oil on the land the ranch is worth at least $1,000.000. He also opposes it on the und that distribution, followed by sale at time. would do_irreparable injury to the estate. The will of Dutard is the sub- ject of four contests and a suit for an ac- counting brought by Dutard’s four heirs against the widow. ———— Abbott’s Will Is Filed. The will of Charles H. SOOI I— Trials of Nolan Gang Set. ‘When the cases of Michael Nolan, Bernard Whitelaw, John Davis and Docia Nolan, charged with robbery, were called fn Judga Coolt’s court yesterday to be set, Attorney W. S_Barnes filed an affidavit to the effect that the testimony taken at the preltminary hearing could not be transeribed for at least thres weeks, owing to its unusual length, and he de- sired to be able to peruse all of the testimony before the trial. Howard Vernon, the sten- ogTapher. corroborated Barnes and the Judge continued all the cases till July 20, Whitelaw will be tried first. ———————— Becomes a Soldier’s Bride. __Harry Riley succeeded in getting $2 to pay for a marriage license and yesterday after- noon he and Clara Stone appeared before Po- lice Judge Fritz with the license. They ad- journed to the Judge's cbambers and wers scon made husband and wife, although Riley balked at the last moment, but was persuaded by his flances to stand up and be ‘man.
