Superior Court Adjudges Ex- tradition Papers Are Sufficient. The case of the argument of the suf- ficlency of the requisition papers issued by the Governor of Washington for Mrs. Adelaide Llovd Smith, over which there has been such a fierce legal fight, was terminated yesterday by Judge Cook, who sustained the argument of the people and remanded the prisoner to the custody of the Chief of Police pending the issuance of the formal order of the court, which be delivered next Monday at 1‘]’ The courtroom was crowded yesterday morning to hear Judge Cook’s decision In the case, and his orders were listened to with rapt attention. W. S. Barnes opensd the session by stating that the day pre- vious he had omitted to embody the fact in his argument that there was no cer- tificate attached to the papers, but the Judge ruled that it was immaterial, and proceeded to deliver his opinjon. He was fully armed with authorities and read and quoted many. Several of the most Ohio, and one in particular, the case of Sheldon, was cited which grounds in the present case. It averred that it was not the intention of the law to dictate the form of words to be employed, provided that the full spirit of the text was exemplified, and in the case under advisement he found such to be the case. He therefore decided the requisition papers to be sufficient and or- dered the prisoner to be held awaiting the issuance of a formal decree, to be on Monday, thereby allowmg the atorneys for the prisoner time in which to file papers of appeal to the Su- preme Court should they so desire. This ends the struggle so far, and on provided all the other cases the docket are disposed of, Sheriff Wil- ns may have an oportunity to proceed with the execution of the powers vested covered ihe To-day Mrs. Smith will appear before both Judge Conlan and Judge Cabaniss. In the court of the last named she will un- dergo preliminary examination in the case brought against her by O. O. Trelease for 270 by misrepresentations of Gander Oil Company.
