Commissioner Lloyd read the resigna- ion of Herbert Schmitz, secretary. The resignation was accepted with regret. Commissioner Altman paid a graceful tribute to the worth and capability of the etiring secretary. Mr. Sullivan echced the sentiment, remarking that he had al- ways found the secretary courteous and obliging. Commissioner McDonald spoke of the secretary’s diligence, fidelity and ef- ficlency and gave the newly appointed Commissioner of Public Works assurance of his good wishes. Commissioner Lloyd suggested that the Park Commission should express its ap- preciation of the secretary’s services in a fitting resolution and moved that Frank J. Sullivan be appointed a committee of one to prepare the resolution. The mo- tion prevailed without dissent. Herbert Schmitz thanked the Comm! sioners for their kind words of approval. Mayor Schmitz also, thanked the com- mission for the expressions of good will. Commissioner Lloyd announced that the Mae Helene Bacon collection of Shasta and Modoc Indian baskets had been re- ceived and would soon be placed in the museum. The Standard Oil Company gave notice of another advance in the price of oil. The advanced price is 80 cents a barrel. Tom Sam On, a Chinese who was ac- quitted by a jury in Judge Lawlor's court on Tuesday, under instructions of the Judge, on a charge of felony embezzle- ment, secured warrants from Palice Judge Cabaniss yesterday afternoon for he arrest of Harm Chew and Wong Fook Sing, who testified against him, on a charge of perjury. He 2lso secured a a charge of subornation of perjury. The cases will be prosecuted by Attorneys George D. Collins and J. 8. Myers, who represented Tom Sam On at the trial. It is alleged that the defendants are highbinders and have been levying black- mail on Chinese merchants throughout the State. Because Tom Sam On refused to be blackmailed they had him arrested on the charge of embezzling $65. They also had him arrested in San Jose on a charge of grand larceny and the case is still pending. It is claimed that the two witnesses who will testify against him on that charge were in this city at the time, —_—— Mrs. Kellogg Released. Mrs. Rose Kellogg was brought before the United States District Court vester- day to plead to an indictmant charging her with having swaern falsely to an affi- davit on a pension claim. On motion of United States Distriet Attorney Wood- worth her bail of $200 was reduced to $300, and she was allowed to go on her own recognizance.
