Attorney General Believes Courts Should Pass on Charter Provisions. Suit will be brought in the name of the people to test the right of Dr. Vincent P. Buckley and other members of the Beard of Health of San Francisco to hold office as members of such board. Attor- ney.General U. 8. Webb has granted the application of Edward J. Lynch for per- mission to use the name of the people in this action. In granting the application the Attor- ney General calls attention to the fact that In removing the old Board of Health from office, one of whom was Dr. Buck- ley, Mayor Schmitz acted within the let- ter of the provisions of the charter of the city and county of San Francisco. The Attorney General then states that he does not wish to asjume the responsibility of passing upon the validity of those provis- fons of the charter, but belleves that the public interest will be best subserved by allowing the courts to pass thereon.
