Wage Bitter Legal Fight to Have Court Set Aside a Judgment. o T TR KANSAS CITY, Mo., Dec. 1.—John B. Henderson of Washington, D. C., repre-| senting the owners of the famous St. Clair County bonds, valued at $344,000 and issued In 1870 to bulld the Lebo and Neo- sho Rallroad, appeared in the District Court here to-day and refuted a charge that the bond issue was secured by fraud. Although the bonds were sold, the rail- road was never built, and Henderson se- cured judgment for the full amount with interest, which now amounts to more thar. a million dollars. To.prevent the juagment from lapsing, he recently peti- tioned the court to renew it. Thereupon ! the St. Clair County officials filed an an- swer to the petition, praying that the judgment be set aside and stating among other things that “St. Clair County, defi- nitely, distinctly, expressly and tively alleges that said judgment was Procured by actual and positive fraud on the part of Mr. Henderson.” Henderson to-day made an impassioned denial of the charges and offered to have the case tried again upon its merits. The attcrney for St. Clair County refused to ag:ee to this and thé court struck out the portion of the answer objected to by Hen- derson. i STOCK QUARANTINE LAW IS CONSTITUTIONAL United ' States Supreme Court Sus- tains the Measure Passed by Colorado. . ‘WASHINGTON, Dec. 1—The United States Suprems Cougt to-day sustained the connnu(lnnallsy of the stock quar- antine law of Colorado. The decision was announced by Justice,Harlan and was based upon the case of 8. H. Reed versus the people of Colorado. The law prohibits the importation of cattle or other livestock into the State from | points south of the thirty-sixth parallel of latitude between April and -November unless they bear bills of health. The law was attacked as unconstitutional and also as antagonistic to interstaté com- merce law and the animal industry law, but the court held the law to be in ac- cordance with the right of the State to protect its own citizens. -An application for a writ of error in the habeas corpus proceedings instituted by Reed was also overruled. Passengers in Consequence Are Udfdble to Proceed on Their Journey. MARSEILLES, Dec. 1.—The strike of stokers, sailors and others here is assum- ing gravity with the arrival of many more’ steamers. The sailors and stokers immediately leave their ships and the pas- sengers are uhable to proceed to their destinations. The number of belated pas- sengers at Marseilles now reaches 1500. Many of the passengers are destitute. The port remained quiet throughout the loitering abéut the mills and wharves, where work Was almost at a standstill. Vessels ar- riving from abroad, however, find no diffi- culty in discharging. Three thousand five hundred strikers met this afternoon and adopted a manifesto demanding that the towing eompanies should cease their ser- vices as regards French vessels. They also passed a resolution calling on all the engineers and stokers to abandon work within twenty-four hours, under penalty of being pronounced false broth- | ers. 5 A delegation of delayed passengers for Algeria and Tunis waited upon the pre- fect of the department. The spokesman, ‘the Assistant Mayor of Algiers, explained | rector of Trinity Episcopal Church the consequences that an enforced stay at Marseilles would have upon these whose business demanded their presence in the towns to which they were proceed- ing in Algeria, while many others were in :absolutely destitute condition. The prefect promised to do his best to ar- range for the transportation of the pas- sengers by way of Port Vendres, and to make an appeal tq the Government to give some assistance to the more needy among them. The passengers afterward held a meeting and. decided to telegraph to Premier Combes and to the resident general in Tunis, calling attention to their grievous situation. Tranquillity prevails in the city to-night. Eight thousand troops are here, and ‘the port is strongly patrolled. Grin Must Go Back to Russia. WASHINGTON, Det. 1.—In an opinion delivered by Justice Brown in the Su- preme Court to-day he affirmed the opin- ion of the California Circuit Court in the case of Simon I. Grin, a subject of Rus- sia, now In San Francisco, who is charged with the embezzlement of 25,000 rubles in his own country and who seeks to evade extradition. The effect of the decision is unfavorable to Grin and the warrant of extradition issued by the United States Commissioner will take its course. Declines the Call to Palo Alto.
