Alleges That It Has Been Worsted in a Eusi- ness Deal. ——— The Rawhide Gold Mining Cempary filed a complaint in the United States ircuit Court yesterday against the Tuol- mne County Water Company and the Tuolumne County Water and Eleefric Power Company for an injunction, an ac- counting snd damages. The complaint recites that om March 9, | 1508, W. A. Nevills, W. H. Martin_and | John Ballard entered into an agreement | with the Tuolumne Water Company whereby Nevills and his associates trans- ferred to the Jamestown Electric Light and Power Company certain electrical machinery, pipe lines, wires, etc., from Summersville to the Rawhide and App | mines, with a branch line to Sonora, in “Tuolumne Cbunty, so that the James- town Klectricai and Power Company should transfer and convey said mackin- ery and eleetrical appliances to the Tuol- umne County Water Company by a con- ditional bill of sale. Nevills and his as-| gociates were to receive 40 per cent of | the net proceeds each month and credit should be given for all the light and pow- | er furnikhed Nevilis and his associates until the full amount of $150,000 should; be paid. It is alleged further in the com- plaint that the respondent sold light and power to outside parties to the extent of $50,000 per annum and that the actual ex- penses did not exceed $6000 per annum. It is alleged also that the respondent has received the sum of $20,000 beyond its pro- portion of the said net proceeds. It is further alleged that the respondent is in- solvent. Kelner, a collector, took fright and ran away as iKelner was about to get into the con- veyance on Ninth street at 2:30 o'clock vesterday afterneon. The animal col- Jided with @ two-horse wagon of the Cali- fornia Bottling Company that was standing outside Odd Fellows' Hall. The team also took fright and the three ani- mals with the wagons came at a mad dash down Market street. A funeral procession just escaped collision and an’ undertaker's wagon was almost upset. ‘The two-horse team continued at a furious pace and at the intersecti of | Market and Turk streets dashed 0 a buggy belonging to Mitchell & Co., real estate agents, completely demolishing it. So great was the force of the collision that the horse attached to Mitchell's bug- gy _was lifted from its feet. The wagon of the Caljfornia Bottling Company was brought to a standstill by coming into collision with a tele- graph pole and the Commercial Fire Dis- patch Company's vehicle was almost demolished before Eighth street was reached. The horse was stopped at Fourth street and was uninjured. None | | of the animals in the runaways and col- lision were in the least hurt. Pedestrians who were in the vicinity at the time had narrow escapes. The ex- citement caused by the shouting of men and the screaming of women was for a time intense. Police Officer James Cook made a gallant attempt to stop the flight of the two-horse team. At the office of the Commercial Fire Dispatch Company it was said that their horse was exceed- ingly docile and quiet in every sense. The reason for the animal's bolting is at- { tributed to its being frightened by a pass- ing automobile. Admission Day at Lake Tahoe.
