Herman Kohn, secretary of the San Francisco Lodge of Elks, who was con- victed on a charge of having a dead elk in his possession, was sentenced yesterday by Judge Cabaniss to pay a fine of %5 with the n'l’unl alternative. Notice of ap~ peal was given. The cases of Charles Ward, who shot the elk, and Antone Fodera, a Wfllt{; dealer, charged with having the dead in his possession, were then called. At- torney Partridge asked that they be not set for trial, as he intended making a formal motion at another time that the cases be transferred to some other court. Judge Cabaniss asked him to state his grounds for making the motion and he Teplied that it was chiefly owing to the Judge’s interpretation of the law, which Would be unfavorable to the deféndants. The Judge said that those grounds would be insufficient and added that if his inter- no gte’ndice in the matter. e cases were then continued till Sat- urday, when the formal motion for transfer will be made.
