All the evidence .in the oil rate cases taken before Rallrond Commissioners Laumeister, Edson and Blackstock has been made a part of the record and the arguments have begun. W. A. Worthing- ton testified yesterday afternoon, and when his cross-examination was conclui ed by Frank N. Short, Attorney Sterry began his argument in behalf of the San- ta Fe road. ‘Worthington is the chief statistician of the Southern Pacific operating depar:- ment, and was armed with figures. Ac- cording to his testimony the company's heaviest locomotive weighs twenty-six tons and is capable of hauling 850 tons. The smallest of the iocomotives has a ‘weight of fifteen tons. Trains on the Val- ley division run from 400 to $00 tons, the average of which was placed at 653 tons on the line from Bakersfield to San Fran ’cisco. Out of this 638 tons 313 tons ate actual paying freight. Worthington’s fiz- ures showed. a cost of $18 per ton mile, minus interest, and $1 10 for return- ing the empties. Worthington concluded with a lengthy statement on the grades between Bakersfield aad Oakland. Sterry’s argument was on the lines of railroad justice and fairness in fixing the rates. OAKLAND, Nov. 26.—Fred Scott, the young colored man who was convicted & week ago for assault with a deadly wea- pon with intent to kill Harry Wilson, also colored, was sentenced by Judge Melvin to-day to serve two years in the County Jail for the offense. Just before passing sentence Judge Melvin, as is customary, asked the prisoner if he had anything to say_for himself. ‘“Yes,” - sald the prisoner, rising and standing in the middle of the courtroom. “I wish to say that I stand convicted of a crime committed while I was trying to protect the name and honor of my sister and family, and under the circumstances I will gladly go to prison.” | _Scott expressed a preference for the County Jall rather than one of the Stare prisons, and Judge Melvin granted his re- quest to be sent there. Karman and Louis Raffetto Jr. The bride has been a resident of Oakland but a short time, coming to this city with her parents about five months ago from Grand Rap- ids, Mich., but the time was long enough for Mr. Raffettos to _woo and win her. The groom is weéll known here, having lived in Oakland nearly all his life. He is a son of Louis*Raffetto Sr., a retired caplitalist. After the ceremony a wedding break- ‘fast was served at the residence of the bride’s parents, 950 Fifth street. A recep- tion followed and later the young people took their departure for San Jose, where they will spend the honeymoon. On their return they will reside at 950 Fifth street, ‘where Mr. Raffetto has fitted up a home for his bride. —_———— CITY TAXES YET UNPAID ARE NOW DELINQUENT Large Sum Will Remain Outstanding Until Courts Settle Assessment Difficulties. OAKLAND, Nov. 26.—The first install- ment of city taxes unpaid is now delin- quent and from tu-d‘y on a penalty charge will be exacted® The amount due the city under the first installemnt is $301,015 82. About $200,000 has been collect- ed, leaving a delinquency of about $100,000. This is caused largely by refusals to pay on the increased assessments on busi- ness property. The revenue from this in- crease would be about $15,000, but more than four times that amount is tied up pending the settlement of the legal points upon which the refusals are hased. —_——— RUNAWAY TEAM CAUSES DISASTER IN HAYWARDS Mrs. Carl Nissen and Miss Emma Pestdorf Sustain Injuries in a Road Collision.
