Lawyer Collins’ Claim That Document Was Filed Is Denied. P T The dlsappearance of an affidavit, sald to have been filed in the County Clerk’s office last Saturday, is causing a deal of discussion at the City Hall. The parties most vitally Interested in the missing paper are Judge Graham, Judgment Clerk Johnny Grief and George D. Collins, the attorney. The affidavit was the basis for an order for the arrest of an actor named Thomp- son by Judge Graham and was shown to the Judge by Collins Saturday morning, ‘when he asked to have the arresting order | issued. The Judge noticed at the time it was presented that it bore no file mark and spoke to the attorney about it. The attorney said he was on his way to the | clerk’s office to have that attended to and | upon these representations Judge Graham issued an order for the arrest of Thomp- son and fixed bail at $500, half the amount of the judgment against Thompson, gain- ed by Mrs. Greer, his mother-in-law, some time ago. That was the last seen of the affidavit, though Collins asserts that he took it to Clerk Grief for filing. Grief is equally as positive that the paper never passed through his hands and sc told Judge Gra- ham and Attorney Coilins. The latter then said that one of the newspaper men had taken the document from the desk, but when offered a chance to identify the reporter would not accept it. The disappearance of the paper is likely to cause a great deal of trouble, as the actor’s lawyer is about to institute an ac- tion for damages against Mrs. Greer and her attorney, Collins. Judge Graham, in speaking of the oc- currence yesterday, said: “I was deceived | by Collins. He did not tell me that he had tried to get an order from Judge Sloss | and failed. I did not know that Thomp- | son, the actor, was the man that was wanted, and when I read the story in_the papers Sunday I went to the Hall of Jus- tice and tried every means in my power to remedy my error. 1 senmt for Collins Monday and when he came he told me that he had laid the afidavit on Grief's | desk. When I told him that Grief said | he had not_he then said a newspaper man | had taken it. The obtaining of the war- | rant in such a2 manner was an outrage.” Sudden Death of a Teamster. James Leroy, a teamster, residing with his mother at 304 Tehama street, died sud- denly yesterday morning. He was taken ill on Saturday night with pains in the stomach, but his mother did not think it necessary to send for a physiclan. He gradually grew worse and collapsed at 4 o’clock in the morning.
