Judge Murasky made an order yester- day denying the motion for a nonsuit in the action instituted by Horace W. Phil- brook against Van R. Paterson. The de- fense then opened. Judge Paterson tes- tified that he had no malice against Phil- brook. He did deem him erratic, however, having seen him act peculiarly.” To show that he bore no malice to’ Philbrook, Judge Paterson stated that he had often permitted him to use his stationery and transact his business in the office of Rodgers, Paterson & Slack. This privil- ege was accorded Philbrook, the witness testified, until he abused the same and complaint was made against him by the employes of the office. Attorney Joseph C. Campbell _testifled that he had frequently seen - Philbrook acting strangely, throwing his arms up- ward and giving other evidences of ec- centricity. Robert Y. Hayne and ex-Judge ‘Wellace testified on behalf of the defend- ant. Judge Hayne directly contradicted Philbrook as to advice given by Judge Hayne to Philbrook as to the best way to proceed- to secure a review of the dis- barment proceedings against the last named.
