Says He Should Have Kicked l’hil-i brook Downstairs for Knock- ing Boisterously at Pri- vate Office Door. It was a bad hour and a half that Hor- Philbrook put in yesterday morning to convict E. 8. Pillsbury of hid- away from a process server. Pills- s deposition in the gardianship mat- | ter of James P. Merritt was being taken | by Notary Mosebach, and Philbrook was | doing the o examining: On a previous | oc ion, about a week ago, Pillsbury | was before the notary, but he left sud- denly to keep an appointment he had, and | Philbrook saw in this action a desire to escape giving evidence. He said so in his questions, and Pillsbury explained mat- ters, but it left him in no enviable frame of mind for what was coming. Philbrook took up the question of the ervice on Pilisbury to appear before the and ed the lawyer if he had s notary, not heard that a deputy sheriff had called | just before the first nearing before mej notary with a subpena for him to appear. Pillsbury said he had heard that a man named Philbrook had called to see him, | saying he had with-him a deputy sheriff, | but Pillsbury said he thought the state- | ment was untrue and nothing more than | a ruse to galn entrance, and so he paid no | attention to it. | Then Philbrook asked if Pillsbury had | not tried to evade summons, and Pills- bury denied that he had done so. He said in answer to Philbrook's questions that one day some cne, finding the door in the hallway to his offices open, stepped in and knocked loudly and boisterously at the door to his private office. He rang the bell for his office boy and sent him out to | find who was knocking, and the boy came | back with word that it was Philbrook and another man. | “My first impulse was to go out and | kick the man down stairs,” said Pilisbury | to Philbrook, “and I'm sorry now that I did not; but'I told my office boy to call the janitor and have him put the man out. I did not try to evade summons, and when I heard that there might have been a deputy sheriff calling on me I rang up the Sheriff and told him If he had any process to serve on me to bring it down arglhl“wuu]d accept service. | ilbrook then tried to bring ou questions that Pilisbury had gone (‘:}'t ’1‘-.‘; the private door to his offices and had gone to the street by the stairway, and not by the elevator, but Pillsbury content- ed himself with the statement that he had | not tried to evade summons, and an- swered that it business which way he went down stairs or what door of his office he came out of. Then William Bosely, who represents the other side of the case, declared that the questions wers being ' put to waste | time., and puiling his watch from his pocket he sald he would walt but fifteen | minutes more, and if pertinent questions were not put in that time he would with- | draw. Pillsbury Supplemented this by saving that he ‘would answer no further | questions about his comings and goings to or from his office, and in view of his statement if any more were asked it Wwould but confirm his opinion that the whole proceeding was taken to annoy him and waste the time of all parties con- cerned. The fifteen minutes passed uneventfully, but by the time they had gone Philbrook had somewhat changed the line of his duestions.
