WASHINGTON June 4.—Therefsreason to believe that the President has decided to appoint General Joe Wheeler a briga- dier-general in the regular army to fill the vacancy which will be created by the confirmation by the Senate of the nomina- tion of General Otis to be a major gen- eral. His nomination was sent to the Senate some days ago and it is believed that the President is only awaiting the favorable action of that body before send- ing in General Wheeler's name. ST Oakland Office San Francisco Call, 11183 Broadway, June 4. The decision of the cramento County Superior Court in the suit of State Con- troller Colgan against Assessor Henry P. Dalton for the collection of commissions alleged to have been illegally withheld for the collection of poll taxes in this county has prompted the Board of Super- visors of Alameda County to bring an ac- tion for the recovery of the money. It was decided by the Sacramento court that the State Controller had no legal right as plaintiff in a suit for the col- lection of poll tax commissions, but that the Supervisors of this county were the officials to bring the matter into court. At the meeting of the Board of Super- visors this morning the question was brought up, and it was decided to bring sult against County Assessor Henry Dalton for the recovery of $3%% 15 amount claimed to be illegally 3 him as his commission on the collection of poll s for last year. Dalton claims the money in question un- der a provision of the county government act, which allows the Assessors of coun- tles of the first class to retain 15 per cent of all moneys collected as poll tax. The county confests the Assessor's right to the money under a different section of the act, which provides that all such money county treasury. In the fall Mr. Brink, accompa- nied by his wife, will attend the theo- logical school in Chicago. —_————— Found With Skull Fractured. < , June 4.—Harry Marshall, colored, 80 years old, an inmate of thé County Tnfirmary, was found unconscious, with his skull fractured, last night on the San Leandro road. Whether he was struck by a car or fell and sustained the injury was not disclosed. The former cause is probably the correct one, for Marshall was found twenty-five feet from the electric road tracks. He was removed to the County Infirmary, where an operation was performed on the injured skul he sur- Marshall will recover.
