It was claimed that powder was sold at an advance to Wiltsee, that Newhouse got a ‘knock- down’ on drug bills and so on, the prac- tice being one. as Attorney Wheeler put it, “of petty thieving and dishonest pil- fering.” A long legal argument followed on the relevancy of the testimony, but finally Judge Seawell sustained an objec- tion of Garret McEnerney, who represents Newhouse. Mr. Wheeler contended that the matter of “‘unclean hands’’ was one for the deter- mination of the Chancellor and that te: timony showing that Newheuse had com into court in the condition prohibited by a _court of equity should be admitted. In any event, Judge Seawell sustained the | objection without prejudice, and the mat- | ter will be further argued this morning.
