Elements of Self-Defense and Tem- porary Insanity Will Enter Into the Defense of the Prisoner. The trial of Joseph Clark for the killing of Joseph P. Gross, which occurred No- vember 30, 1888, in front of the fire engine house on Stockton street, between Pa- cific and Broadway, s progressing rapidly In Judge Dunne's "court. The trial promises interesting developments. Clark, the defendant, claims that Gross had been Inttmate with his wife, and, in fact, Mrs. Clark left her husband about three months before the shooting, went to live away from him and took, Gross | into her home as a boarder. Clark says that the dead man broke up his home through questionable means and the loss of his wife turned his mind and culmi- nated in his arrest for murder. Although the defendant does not deny that he de- liberately killed Gross, a certain element of self-defense will enter into the case, as it is contended that when the two men met just before the killing Gross made a threatening movement and then a bul- let from Clark’s revolver ended his life. Louis P. Boardman, who made the last appeal for Durrant before the United States Supreme Court, and H. Dighy Johnston are representing the prisoner. Rellance for acquittal of the defendant rests upon the contended justification of the killing through Gross’ acts in wreck- ing Clark’'s home, while if this fails a technical fight on the ground of insanity, the element of self-defense and other points will be made, After the jury was impaneled yesterday George W. Russell was placed on the stand to exPlain the chart he had drawn of the engine-house, where the killing took place. Thomas J. Coogan, a fireman, was next sworn. He proved a reluctant witness, at least when it came to cross- examination, and causcd heated words between the court and counsel for the defens He admitted having been to Mrs. Clark’'s home with the dead man and had been told by the deceased that he “boarded” with the defendant’s wife. Dr. Campbell Ford was called to testify that he was summoned after the fatal shot had been fired and found Gross dead, and Fireman John J.
