Making Big Steel Oil Tanks, Many Boxoars and Doing Much Repairing, The activity at present in the Southern Pacific Company’s car works and repair- shops in California is the greatest known in many years, and is declared by General Manager Kruttschuitt to be the best barometer of business throughout the State and 2 most reliable indication of the advent of better times. In the Southern Pacific cershops at Sacramento there are now busily at work 215 men, considerably more than have been employed for a long time. In addi- tion to a rush of general businessand the present construction of 100 stock cars, the men have just begun the coustruction of twenty-five steel-tank oil cars, each wiih a capacity of 6500 gallons, each to be fur- nished with automatic air-brakes and couplers, all the most improved safety de- vices in compliances with the Federal luws, and heating pipes under the tanks to warm the oil and make it flow readily. These cars are intended especially for the ) Southern Calitornia oil business. The first few will be turned out compieted this week and afterward one will be completed each six days. The company aliready has in service and owns twenty-five oil cars similar to these and fifty smaller oil cars that it nhas leased from Eastern railroaa companies. In the company’s repair-shops at Oak- land 816 men are now at work, whnich is very many more than have had employ- ment there usually In the repair-shops at Bakersfield and Mojave for the San Jozquin division there is a total of 182 men. In the Los Angeles shops there are 437 men. Up at Duns- muir their are mow 63 men at work, and in the coast division repair-shops thers are 341 men, all rushed with work. So, to-day 3044 men are actively in repairing cars and building new ones ibe snops of the Sontbern Pacific in Cali- fornia. And this is a condiuon of activity as unu-ual asii is suggestive ot the return oi busy, prosperous times. There is more freight to be shippea this year than in any one of the preceding dull seasons, and the lively traffic bas resulted in repairs to cars heretofore little used and the buila- 1ng of new cars. CAPRON WILL CONTEST, His Stepdauchters Ask for an Estate Worth $100,000. Charge of Undue Influence Made by the Attorneys for the Young Ladies. Attorney Henry E. Highton made the first formal argument in the John 8. Capron $100,000 will contest yesterday morning before Judge Coffey and a jury. Mr. Highton stands as the champion of Judge A. L. Fitzgerald of Nevada, who claims the right to act as executor of the decedent’s will. Ex-Judge Henry Meyen- baum, E. 8. Pillsbury, Alfred Sutro and Treodore Roche appear with Mr. Highton, On the o her side are Attorneys Reddy, Campbell & Metson, E. T. Moz«n, Joan H. Durst and Weif & Jacobs. These repre- sent the three : epdaughters of Mr. Capron, who oppose Judge Fitzgerald's claim 10 contrel the affairs of the dead man. Mr. Highton drew the attention of the court to the unusual circumstance that in tais action two wills have been filed for probate and that they are in conflict in all particulars of importance. He there- jore apnealed to the court for a ruling as 10 the mode of procedure in presenting the evidence. Judge Coffey replied that the issues would be tried on the issues raisea by the pleadings, and that Mrs. Hattie M. Kear- nv, Mrs. Madge Manion and Miss Mamie E. Capron should take the iniliative. Myer Wolf presented the opening state- ment on behalf of the stepdaughters. He said it was proposed to show tuat from the time that Mr. Capron married the widowed mother of these young women up to the day of his death he had regarded them as his own children; that he lived in tke same honsehold with them; that there was the greatest affection between them; that he often told people that he was worl ing for his three daughters, and that they were 10 have all bis property; that he even went farther and actually did give bis stepdaughters all his property, by deeds of gilt of real estate, assignment of mortgage and transfer of stocks and ponds; that he made several wills, and thatin all of them he bestowed all his property on these three young women in accord- ance with his oft-repeated intention touching this matter. But there came a change in the physi- cal and mental condition of Mr. Capron, according to Mr. Wolf’s recital, resulting from the excessive use of morphine and other drugs ot similar nature. dir. Cap- ron went to the springs for a time, but re- turned in worse condition than ever. He began to mutier to himself, grew sus- picious of everybody, thought he was about to be poisoned, threatened to com- mit suicide and finally aid commit suicide by shooting himself in the head. It was after the return from the springs that the holographic will was prepared and signed by which Judge Fitzgerald wis named as executor and the“\bulk of the estale was bequeathed to tha/fitzzerala family. This holographic will\PIr. Wolt declared, was procured by the vndue in- fluence of Judge Fiizgerald, who was an old friend and adviser of Mr. Capror, and he furtber contended that Mr. Capron was mentally incompetent 10 make a will st the time the holographic will was sizned. After the opening statement there be- gan the usual legal fencing with which all will contests open. J. C. Campbell a-ked for the production of the vrivate papers of the deceased and it was ordered that they be aelivered in court. In the aiterncon, Mrs. Neilie McDer- mott, who was present when the holo- graphic wili was signed, testified that Mr. Capron had been very sick with rueuma- tism and bad taken considerable mor- phine at aifferent times, but she thought he wus of sourd mind when he made the holographic will. Other testimony will be heard to-day, and it is probable that the trial will last for several day-, T ————— The Corn Doctor Arrested. John O'Conuor, the corn doctor, who stabbed his wife Mary at her home ou Lafay- work ette street Sunday night, was arrested yester- day morning on a charge of assauit to murder. They have been living apart for some time. Mrs. 0’Connor was not able 10 appesr in court yesterday and the case was continued ull Saturday. ——————— Tracy Loses the Money. The Supreme Court yesterday decided in favor of William Alvord and other executors of the late J. C. Wilmerding in the case of Felix Tracy against the executors. Some time aiter the deain ot Wimerding, February 20, 1894, the executors found among hl!‘rlpflm a promissory note mede by Wiimerding six months previous to the death mentioned, to Tracy for $10,000, the existence of which Tracy was ignorant of. In the action in the lower court he endeavored to show that the note was in the nature of & giftand was a de- mand ageinst the estate. The lowe: court de- cided against his claim on the ground that there had been no delivery of the note ana it was of no effect. Also that it was not a gift. It was merely the promise of a giit, and en- forced no obligation. This decision was sus- tained by the Supreme Court. —————— Supersedes Hughes. G. H. Coons, a white man, was yesterday appointed by Collector Fackson to fill the va- cancy caused by the dismissal of C. A. Hughes, the colored messenger of the Appraisers’ Office.
