PoWDERLY, Comui The Japs will be sent back to Yoke- bama on the City of Peking at the es- vense of the Government, and the Cina- | dian Steamship Company, which brought them from Japan, will be called upon to make good their passage money. This was a test case, it having reached the ears of the Commissioner that 1500 Japs with eimilar contracts are waiiing for the de- cision. Had it been in favor of the six- teen this gang, with many more, would | embark at once for the United States. | On the 1st of August seventeen Japanese | men ranging from 17 to 36 years of age 100k passage on the steamship Coptic from Kobe. On their arrival at Yoko- hama Unitea States Consui-General Mec- Ivor discovered that they held labor con- tracts with an emigration compaay, the Emin Kabushiki Kaisha, at Kobe, for labor to be performed n the United States. General Mclvor certified to that fact on the immigrant list of the Coptic, and the seventeen Japs were accordingly denied further passage on the Coptic. They, however, took passage on the Olympia for Victoria, and when they ar- rived at that port they secured certificates from the Commissioner ot Immigration there and came to San Francisco on the Walla Walla with a lot more. The s: teen were arrested at this port by Immi- gration Inspector Geffeney. Commissioner Siradley wired an ac- count of the facts to tue Treasury De- partment at Washington and received instructions to deport the Japs, but at the request of Funa Koshi, Japanese Consul at this port, an appeal was granted and the papers and a tranaslation of the contract were transmitted to head- quarters. Mr. Stradley called atiention to the fact that it was not likely that a company would be organized for the purpose of lending money to laborers without inter- est, and have agents in this country to look after them for the period of two vears for the small fee of $5. He suggested also that the Japanese gentlemen in this coun- try, who were to act as agents, could not afford to devote two years’ time iooking after a lot of farmhands. Mr. Stradley lay stress upon the fact that the arrested immigrants aeclined to give the names of the persons who advancsd them the money for their passage ard also the names of the agents. The agents were called for, but aid not appear, and the fact that they | ‘were 50 mysterious in their actions was a proof that they were simply employment agents having the men under contrac:. The attention of the department was also called to the fact that the law speci- tically commands the aeportation of all immigrants whose ticket or passage is paid for by the money of another or who is assisted by others to come to this country. | The following is a translation of the contract: With the object of rendering physical ser- vice in agriculture, by his own deed, in the United States of America, the emigrant [blank | for name]. on one side, hereby appointiug two | sureties and applying to Kosei Emigration | Company, and the said company, on the other side, accepting the application, do mutualiy enter upon the following contract with regard to the immigration: Articie I—The said company sball apply for the emigrant’s passport and make other neces. | sary arrangements with regard 1o the emigra- tion. All expenses in regard to the cmigration and returning home shall be deirayed by the emigrant. Article II—In case the emigrant be unable tosupport himself, through illness or other distress, in the place of his emigration the agent duly sent by the said compsny shall give reasonable assistance to or undertake to send him home. Article I1I—The term of the present con- tractshall be three yesrs from the aate on which the present coniract has been entered upon. l;u-m:ls IV—In case the emigrant under the management of the said company be sent home through the protection of H.L J. M.'s authorities abroad, or ii he receives protec- tion from the same, all the expenses incurred therefor shall be repaid by tne said compsny. Article V—Each emigrant shall pay the said company the sum of 10 yen (about $5) as the fee for making arrangements for the emi- gration. Article VI—The emigrant and the said two sureties shall be under a joint obligation to reimburse at once when claimed by said com- pany the expenses which shall have been paid or made good by the said company in accordance with the second and fourth arti- cles of the present contract. Article VII—The two said sureties shall guarantee goodness of the emigrant’s be- havior and shall be responsible for all occur- Tences of the emigrant’s personal interest. In witness to keep firmly each other the above articles two copies of the present con- tract have been made, and one is taken by each party. UKIAB'S LONGITUDE. It Will Be Established in a Few Days by a Government Geographer and Astronomer. C. H. Binclair of the United States Coast and Geodetic Survey arrived from ‘Washington a few aaysago for the pur- pose of detérmining the exact latitude of the city of Ukiab, in ‘Mendocino County. Mr. Sinclair is an expert in that kind of work, and for that reason he was selected to_come to California. Ukiah city has been on the map for a good many vears, butit has never been in the right place. Itslocal time has never been exact for the same reason.
