Believes That the Reduced Al- lowance Will Be Insuf- ficient, He Does Not See How He Can Keep Business Up to Date on $6000 a Month, County Clerk Curry has appealed to the Judges of the Superior Court for an inter- pretation of the luw touching the running ot his office under the reducea appropri- ation that is to be placed at his dispesal by the new tax levy. He has written a stter to thei- Honors which he will ask to consider in bank. The letter of them Mr. Curry is 2s follows: As County Clerk and ex-officio Clerk of l.he Superior Lourt of the city and countv of San Francisco, I respectinlly beg leave to call your carnest attention to the existing state of ai- fairs in reference to the apportionment made by the Board of Supervisors for .he Count Clerk's office. On February 13, 1880, the Legislature passed an act which provided as foilows: 1p all cases in which by statutes in force’ on the 31st aay of September, 1879, the County Clerk of any county, or city and county, Is_authorized to wppoint deputies or assistants 1o whom dutles are sssigned by such staiu.es, in or in connection with any of the courts which were abolished oy the constitution, the Clerk may assign to such deputies or assistants duties in or in counection with the Buperior Court of his county, or city and county, #ua they shall be entitied to the same compensation as is provided in said statutes, and the same shall be sudited and paid at the same time and in the same manuer and from the same source as is provided therein. The last act passed by the Legislature prior to the adoption of the mew constitution in reference to the County Clerk’s office of the city and county of San Francisco was ap- proved February 5, 1872 That act provided that the County Clerk micht appoint for each e courts then in existence one register and one courtroom clerk &t a salary of §175 each, and two assistant register clerks at & salary of $150 per month each, and three copyists for the entire county. - Sup-equently similar acts were passed to spply o courts that were hereafter estab- lished. On April 2, 1880, the Legislature passed an | authorizing the County Clerk of any city and county having over 100,000 inhabitan 10 appoint four competent persons as depu- ties, assistants and copyists for each Judge of the Superior Court of said city and county and as many copyists «s the business of the office should require; provided (hatsuch copy- 1sis should not exceed three for each Juage of the Superior Court, and_fixed the compansa- tion of said copyistsat §3 per day, and pro- vided that the compensation of the deputies and assistants so appointed should be the same as fixed by the siatutes in force on the 31st dey of December, 1879. The various County Clerks of this city and county since January 1, 1880, have conducted ineir office, made their appointments and fixed the salaries of the deputies and assis ants and copyists in accordance with the stat- utes last nbove referred to. In some instances tne County Jlerks, in or- der to keep within the appropriation fixed by the Board of Supervisors, have fixed aries of the clerks &t fixed by the statutes of 1872, but in every siance where the question has been brought before the Supreme Court that court has held that the one-lweiith act was not applicable to deputies whose compensations snd salaries were fixed by law. I respectiully call your attention to the ceses of Cashin vs, Dunn, 58 Cal, 581; Welch vs. Strother, 74 Cal,, 413, and Lewis'vs. Wid- ber, 99 Cal., 412. 1t is now claimed, for the first time since the adoption of the new constitution, that the act of April 2, 1880, is unconstitutional. ihe Boxrd ol fuperyisors has fixed the com- pensation for the Couniy Clerk’s office for nine months, commencing October 1, per month, and has upon the proposition that the County Clerk was ouly authorized 10 appoint the number of deputies specifi-d in the act of 1872, and the various amenament that were made theretc, prior to December 31, 1879.
