10 THE SAN FRANCISCO CALL, FRIDAY, AUGUST 20, 1897. IPERT ANES ONDER THE BAN His Lecture on the Craven Deeds Gets Him Ints Trouble. He Is Cited by Judge Slack for Alleged Contempt of Court. Evidence Being Taken to Break Down Aitken's Story Regarding Mar- tin Kelly's Conduct. Mrs, Nettie R. Craven has seized upon an opportunity to plav even with Daniel T. Ames, the venerable Eastern hand- writing expert, who took the witness- stand some time ago and testified that her deeds and the *‘pencil” will were forg- es. Since his appearance on the stand Ames has been delivering lectures now and then on the subject of handwriting, and it was one of these that gave Mrs. Craven her opening. It appears that Ames adver- tised that in the course of this lecture he would discuss and dissect the disputed documents in tne Fair case, and demon- strate to the saiisfaction of his audience that the papers were out and out fabrica- tions. Judge Curtis, one of Mrs. Craven's at- tornevs, addressed Judge Slack on the subject of Ames’ conduct at yesterday morning’s session, and also presented to the court an affidavit, sworn to by the lady, and setting forth that the lecture greatly injured her rights in the present litigation. In accordance with this showing Judge Slack directed that Ames be summoned to appear in court and <how cause why he shouid not be punished for contempt. Ames will have his hearing next Monday morning. Mrs. Saran Johnson, proprietress of the Colonial Hotel, spent all of yesterday morning’s session on the stand. She re- iterated what she had said on the day previous about Mrs. Craven having shown her the deed= in December, 1894, and prior to Senator Fair's death. The mo:t im- nortant addition she made to the state- ment was that Mrs. Craven had slso told her some time in September of that year that Senator Fair :ad left a will in which he had provided $50,000 for the teachers’ annuity fund. Mrs. Johnson was given a lively shaking up on cross-examination, but she insisted that she had told nothing but the truth and had no interest in the case. Mrs. Johnson was asked a few unim- portant questions by the counsel on both sides and then excused. Mr. Delmas arose at this juncture and announced to the court that he was not aware when George R. Williams was placed upon the stand, Wednesday, that that gentleman was an attorney for the defense. Had he known that fact, he said, he would not have offered the gentleman as a witness. Mr. Delmas said he wished to withdraw Mr. Williams and hig evidence from the case. The attorneys on the other side objected, and Mr. Delmas’ request was denied. Louis Whitcomb, a well-known jour- nalist, was the next witness. He was called to tell about having reported for the Chronicle the proceedingsof a politi- cal meeting at the Baldwin Hotel on the evening of July 9, 18%. Martin Kelly was at that m ng, he said, and re- mained there all the evening. The object of the evidence was to rebut the story of John R. Aitken to the effect that he met Kelly and others that night at Mrs. Craven’s house and talked about the deeds. Aitken had tified that he and Kelly left Mrs, Craven’s house at about 8 o’clock tocome into town. Mr. Whitcomb saia he was not sure that be saw the volitician prior to 8:30 o'clock, so Keily could really have been at both places. Jacob Levi Jr., a wholesale grocer, nar- rowed the time ‘down a little by saying that he saw Kelly in the lobby of the Baldwin before 8 o’clock. Jeremiah Sullivan, a_painter, attended the meeting at the Baldwin and was cer- tain that he saw Martin Kelly in the lobby some time before the meeting was called to order. The meeting was called for 8 o’clock. “Ars you nositive as to the time?” asked Mr. McEnerney, who was conduct- ing the cross-examination. “Quite positive,” replied the painter. “'Did you look at your watch ?"” ~1 did.” *“W hatfor?” : “Why, to see what time it was. That was one on McEnerney and he blushed profusely. Rev. Edward J. Depuy succeeded Sulli- van on the stand. e said he called at Lawver Ruef's office late in the afternoon of July 9, 1896. He remembered having seen Martin Kelly there. As near as he could recollect he saw Kelly as late as 6:15 o’ciock. He did not know the politician to speak to, but recognized him, as he had known him by sight. On cross-examination the reverend gen- tleman said he fixed the dale by the fact that there wasa flag-raising at Portsmouth square on that day, and besides he had consulted a memorandum in Mr. Ruef’s office. Pablo Sanchez Thinks That They Must Have Been, A " Friendly” Game in Which Marion Wilson Jr, Won $110. Received Checks for the Amount, but When Payment Was Stopped He Disappeared. Marion Wilson Jr., a relief police pstrol driver, mysteriously disappeared from the view of his friends and family about two weeks ago. He is being diligently searched for by Pablo Banchez, who is connected with a prominent life insurance company of this City. On the 6th of this month Wilson and Sanchez met in a saloon in tne rear of H. ‘W. Seebeck’s grocery-store, 940 Oak street. Though strangers at the time, & few small drinks created a friendship. Now Sanchez is sorry he met Wilson and Wilson is anxious that a second meeting shall not take place. After each had treated a few times, Wil- son proposed that they shake dice to de- termine who should pay for the next “round.” It was agreed to by Sanchez, and many ‘shakes’’ followed. The dice used belongea to Wilson. Finally the drinks came Jess frequently and mobney became the stake. Sanchez lost steadily and as he became short of ready money be gave Wilson his check on the California Safe Deposit and Trust Company. The stakes increased with the excite- ment and at thc end of the ‘social little time” Wilson held eleven checks of $10 each signed by P. Sanchez. Next morning Sanchez, becoming sus- picious that something was a iittle out of order, went to the bank to stop payment on the checks, but Wilson had already cashed part of them. The teller of the bank was told by San- chez that he wanted the payment on the checks stopped, for the reason that he head been indnced to give them in pay- ment of money lost while shaking dice and that he had afterward discovered that the dice had been tampered with. A short time afterward Wilson returned to the bank to cash the remaining checks, but he was notified that they would not be honored. He then had a friena indorse the checks, which were then distributed promiscuousiy among cigar-stores, busi- ness-houses and brokers’ shops. The checks were presented for payment by the hoiders, but without avail. Then Wilson was wanted to straighten out the tangle, and his disappearance was discovered. There will probably be a dice game now to determine who will be the loser in the transaction—the friend who indorsed the checks or the man who issued them. THE BOONE MATTER. Depositions of Chicago Lawyers to Be Taken in the Case. The disbarment proceedings instituted in the United States Circuit Court by Al- phonzo Bowers against Lawyer John L. Boone were taken up yesterday morning. By consent a commission was ordered is- sued to take the depositions of Thomas A. Banning and Cuarles K. Offield, lawyers residing in Chicago, the commission to report on September 6. Boone in his answer admits that he of- fered his services to Bates as against his former client, Bowers, but avers that he had a nght to do 80, and that the infor- mation which he is alleged to have offered to Bates’ attorneys was not acquired by Boone from Bowers, but from outside sources not of a confidenfial nature. The answer exposes a transaction of Bowers with reference to the broken part of a model of Bowers’ dredger, which model seems to play an important part in the litigation against Bowers. —— HOTEL ARRIVALS, NEW WESTERN.
