Kellogg, Former Client, Com- plains Bitterly. a Says He Was Defrauded by His Attorney While He Was Drunk, Judge Hebbard Says the Only Question in the Case Is the Plaintiff's Competency. Ex-Judge Walter H. Levy appeared as defendant in a sensational lawsuit in Judge Hebbard’s department of the Superior Court yesterday. The action is entitled Mau vs. Levy, but in the proceed- ings it is throughout assumed that the real plaintiff is the main pariy in interest, pamely Edward Keliogg, son of the late Calvin W. Kellogg. In fact Mr. Kel- Jogg 18 at all times mentioned as the plain- iff, the assignee, Mau, appearing only wonen the formal pleadings are read. The complaint alleges that Kellogg was induced to sign a contract whereby he was to give Mr. Levy balf of all that he could recover from the estate of the late Calvin ‘W. Kellogg, who left property esti- mated to be worth abou: $500,000. Kellog; says that he was taken to Levy’s office by one A. E. Taylor, who is described as a unner for Judge Levy,’’ while he, the said Kellogg, was too drunk to know what be was doing, and that he was not men- tally competent to make a valid contract at the time he appended his signature. He charges that Mr. Levy took an un- fair advantage of him and by his actsin the premises defrauded him of his prop- erty. He says that there was nothing important for an attorney to do in the case. eitherin or out of court, and that as a matter of fact Mr. Levy never per- formed any services of any considerable value. He declares that he is willing to pay all the services are worth and asks for a bill of particulars so that the court may fix the fees at a reasonable figure. In conclusion he demands judgment against Levy for the sum of $3000. ‘Attorney L. E. Phillips opened the trial by reading the complaint, after which Mr. Levy ssked permission to make a statement of his position in the liti-ation. He read from the answer the denial of all tne allegations of ‘the complaint and said_ he would prove that the plaintiff Kellogg called at his office before the death of Kellogg Sr. and said he had no expectation of receiv- ing anything from the estate. However, he wished to reialn the services of an attorney, and in accordance with their verbal agreement the contract now 1in court was drawn and executed; that the plaintiff (Kellogg) bhad a copy of the agreement and acted urier it for two vears, taking all the money that the ex- ecutors of his father’s estate could be in- duced to give up, less the amount that he had agreed to pay his attorney. o des- perate were the chances of the plaintiff (Kellogy) considered in the litigation that even the attorney who brought this suit admitted that Kellogg was not entitled to $1, yet ho bad secured not less than $4700 £ r him from theestate. Mr. Levy added: “We expect to show that this claim was assigned to Mr. Mau for §$1 50 and that Mr. Kellogg did this because he said he was ashamed to appear in courf against Judge Levy, who had been so kind to him.” A. E. Taylor, the so-called “runner,” testified that he had a conversation with Eaward E. Kellogg about the death of his tatoer, Calvin W. Kellorg, and continued: “I took Mr. Kellogg to Mr. Levy’s private office and told him that Mr. Kellogg's father was about to die and that he was in need of a lawyer. Mr. Levy agreed to act as Mr. Kellogg's atlorney, and gave him $10 because I told him that Mr. Kellogg was penniless. Afterward he zave about $30 to Mr. Kellogg when he needed the money. Isaw ihe money pass. “This contract was signed in my pres- ence. Mr. Nougues produced itin Judge Levy’s private office. Judge Levy did not request me 1o get Mr. Kellogg. It was M. 8. Mengass who asked me to do that. So I went and found him and delivered Mr. Mengass’ message. We went together to Mr. Mengass' house on Pacific avenue. We had a drink and Mr. Nougues asked him to read over the contract careiully and sign it. We had two drinksof whiskv at Mr. Mengass’ house. Mr. Kellogg said he would refuse to sign the contract until he had a chance to get the advice of Mr. Donnell. We went to Mir. Levy's office and took several drinks on the way,which were paid for by Mr. Nougues. I don’t know what relation Mr. Nougues had with Mr. Levy. When we reached the office Mr. Levy was not there. Mr. Kellogg again refused to sign unless I would go and get Mr. Donnell, so he could consult with him. I promised to do so and went downstairs and stood down by the door- for about half an hour. Whil- I was was absent from the room Mr. Mengass took him out to asaloon and Isuppose he took another drink.” What the witness ‘“supposed” promptly stricken out by the court. ““When I reiurned to the room in Judge Levy's office I told Mr. Kelloge that I did not go for Mr. Donnell, because it was a long way and I had no carfare,” contin- ued the witness. Thereupon arose a controversy as tothe method of the signing of the contract. It was brought out that Taylor signed as witness first, ana that Mr. Kellogg signed rward. sn’vit a fact that he was induced to sign the contract by you saying, ‘I’ll show you that I’m not afraid of thiscontract,’ was and that you therezpon affixed your name?’asked Mr. Phillips. The question in this form was ruled out, but the witness finally succeeded in get- ting on the ri cord the fact that he argued with Mr. Kellogg and told him the con- tract was fair, ail (hings considered, after which Mr. Kellogg signed it. . Judge Hebbard thought it would be necessary to thow that Kellogg was ad- dicted to the use of intoxicants to such a degree that he was incapacitated before any point could be made on that question. It would not do to consider invalid every contract made by men who drink once in a while. ‘Witness Taylor denied that he ever told Mr. Levy that Mr. Kellogg was a dissi- pated man. Mr. Levy was able to judge for himseif. It was a fact that Kellogg was drunk most of the time after he got some money from his father’s estate. Mr. Terry atmounced that Judge Levy made no objection to leading questions, and Mr. Piiliips asked Didn’t Kellogg tell you that he in- tended to employ George A. Knight as his atterney, aud didn’t you advise him to employ Judge Levy 7”7 “Yes.” “Didn’t you talk with Judee Levy be- fore that, and didn’t he say for you to bring Kellogz to him instead of having him go to Mr. Knight and that he would pay you well, that is make it well worth your whiie?” “I don’t remember.”” “D.dn’t you tell Mr. Temple so at bis office on Larkin street at the time of the signing of an affidavit touching this mat- ter, on June 9, 18972 “No, sir.”’ This was evidently a surprise to Mr. Phillips, for he asked if the witness had not demanded money asa prerequisite tothe signing of the affidavit, and Taylor replied that he had asked for his $2 wit- ness fee, but didn’t get it. He said that Judge Levy had agreea to pay_ him $500 jor his services in securing Mr. Kellogg as a client, but he had received only about $200. The offer by Judge Levy_ to pay $300 was after the signing of the Kellogg contract. / On cross-examination Judge Levy said he nad only one question to ask. He wanted to know if anybody had been to the witness on his behalf, and Taylor said that nobody had spoken a word to him about the matter. & M. S. Meugass remembered the signing of the contract. He acted as a friend of Judge Levy and received no compensa- tion for his services. He deniea that he gave Kellogg and Taylor any whisky, but finally remembered that they took one darink together. He said it was not true that Taylor signed the contract first. He was there as the friend of Judge Levy and be saw thatall was regular in the transac- tion. Judgze Hebbard remarked that he did not consider it of importance to ascertain who signed the contract first, as the in- strument did not need a witness to make it binding. As the pleadings stand there is but one point to be settled: Was Kel- logg competent to make a valid contract when he signed the document in court?
