FRANCISCO CALL, FRIDAY, JULY 30, 1897 NONE HAVE A3 - YET DESERTED Judge Slack’s Gold-Fevered | Jury Still Remains Intact. It Was a Day Consumed for the Greater Part in Ar- gument, Ihe Desire Is That Attorney Lloyd's Contract With the Fair Heirs Shall Be Produced. Judge Slack gianced askance at the jury-box when he opened yesterday’'s ses- sion of the Fair-Craven trial Two of the jurors were missing, and vis- ijons of all sorts of annoying complications | incumbent upon their possible flight to| the Kiondyke gold fields flitted through his Honor's mind. But the bailiff’s call at | the courtroom door disclosed the fact that | the truants were only trying to finish the | stumps of their cigars out in the corridor, | and when they hurried into the room to answer to their names the Judge heaved s | sigh of relief and bade the attorneys pro- coed with another long day. | The fire of the gold fever has by no | means been extinguished in the breasts of | at least three of the Fair-Craven jurors, | however, and it is just possible that with the departure of the next steamer for the | frozen regions there may be a vacant seat | or two in the box. | Attorney Reuben H. Lloyd, in whom | Mrs.Craven confided so implicitly up to | tne time that he and the other attorneys | jor. .tie Fair heirs deserted her and| her rights, occupied the witness-stand throughout yesterday’s session, continu- ali¥ uncer cross-examination by Mr. Del- | mas. | Mrs.-Craven was not in court, but_her éhair was pre-empted by her daughter, | Miss Mitgaret. Beside the littie laay st Judge “Qurtis, the celebrated New York lawyer. The Judge has not been address- ing’tite court much during the past few days; leaving that matter to his leadcr, Mr. Pelmas. But he maintains his wonted | vigiiance and is always conspicuous in the conierences of counsel. j Mr. Lioyd inaugurated the day’s siege by aakingz permission to correct a state- ment he made while on the stand the d before. He had testified that he never v fered Mrs. Craven $500,000 for her deeds. | W hat he wished to do now was to omit the qualifying phrase, “for her deeds.” | The remainder of tne forencon session was consumed for the greater part in ar gument. The depate received its impetus from a question from Mr. Delimas calling | for the disclosure by Mr. Lloyd of his re- | lations with his clients, the Fuir children. | The witness made a partial answer beiore the ohjections arose.” He said that he did not think he was the attorney in fact for | the heirs, but had been employed to con- duct certain negotiations for them. “Was that employment authorized in writine ?” asked Mr. Delmas. Mr. Lioyd said it was not. “Was your authoriy to act as their at- tornev in law in writing?”’ was the next question, and that was the rock upon which th- keel split. | There was a long talk as to whether or | not the witness could be compelled to divulge alieged privileged communica- tiops, but the court finally ruled that he | must answer. | Mr. Lioyd said he had a written contract with the heirs, but did not have it with | him. | Thereupon Mr. Delmas made a formal | demand for.the production of the contract | in cotirt, and that started an argument | which- lasted up to recess time and which is not settled yet. During- tlire debate Mr. Foote made a point-for'the defense when he accused the | other side of thanging front. They cared nothifig :for privieged communications, | hesaid, when thev put Judge Aitken on | the siand’and caused bim to divuige the alleged transactions he had had with Mras. | Craven, --What was sauce for the goose | should be sauce for the gander, was his | elosing shot. Just as recess was being taken Judge | Slack-said he would take the matter under | advisement, but later in the day he said he.wolild hear more argument this morn- | ing before giving a ruling. | Mr. Lloyd was questioned with reference | to his..conversation with Mrs. Craven, in which Mrs. Fair's will was spoken of, at | the-opening of the afternoon session. | The. witness said he could not possibly | tecall. the: lady’s exact language. Butin | Substance she said she reminded the Sen- | atar that -his divorced wife had shown a | préference-jor the two Fair girls in dis- | posing-of: hier property as against the son Charles. - The giris got hali a million more .than Charles. Mrs. Craven, he | thotight, said she. advised the Senator to | “make €harley even” in his will, and 1hat the Senator agreed to do this by giving his 8on &n extra haif million. This prom- 1se' was fulfilled in the pencil will. Tieat subject was dropped and Mr. Del- mas wanted to know something in detail | about ‘the witness' connection with the rough copy of the pencil will furnishad him by Mrs. Craven. After he had in- | spected .it, he said, he put it aw:y among | a lot of other papers. Somebody came and | asked for it—he aidn’t remember who— but he could not find it at the time. When it was determined io fight the | pencil_ will, however, he did find it, ard he gave it to Carvalho, the handwriting | expert. It consequently went into the | hands of Attorney Wheeler, who used it in court. Then the conversations wers again re- verted to. *Did not the conversation between Sen- ator Fair and Mrs. Craven, with reierence to what property he was to give her, take place betore the execution of the ink and pencil wills?’ asked Mr. Delmas. “'She told me that they had several con- versations in which that matter was dis- cussed,”’ replied Mr. Lloyd. *‘Ske did not designate just when they took place.” “Now, Mr. Lloyd, don’t you know that those talks took place before that will was drawn ?” *‘Well, that was what I inferred; I didn’t know it.” . The contract by which the Fair heirs were to pay Mrs. Craven $500.000 for her claims was the next subject of discussion between Messrs. Delmas and Lloyd. The latter said that the contract was drawn up and signed in his office. He was there when each of the heirs signed it. He re- mempbered that they were all in the City at that time. “Do you know who drafted that con- tract?’” asked Mr. Delmas. “I do,” was the reply. This would have been an interesting thing to know in view of the testimony that bas already gone on the record to the effect that s “loophole’” was purposely left in the contract through which the heirs could evade payment of the agreed sum after they had wrested Mrs. Craven of her right<. But Judge Slack sustained an objection to the disclosure, and the identity of the clever drafter remains a secret. The contract, said Mr. Lloyd, was given to Richard Dey after it had been sizned. He was commixsioned to carry out the -terms of the instrument provided Mrs. Craven fulfilied her agreement.
