The necessity for the appropriation was set forth by Boatelle. ‘The explanation led to interruptions by Simpson and Gaines of Tennessee, with inquiries as to the appointment of com- mittees. The fac-simile signature of T00K THE LIFE OF HIS BENEFACTOR Murderer of Lyons at Port Blakeley Is Captured. John H. Moss Charged With the Death of the Hotel Proprietor. Detectives Arrest Swanberg as the Man Who Accompanled the A sin. SEATTLE, Wasx, June 21.—The law officers are supposed to have run to earth the perpetrators of the murder of Michael J. Lyons at Port Blakelev Friday nightin the persons of one Swarberg and John H. Moss, who were arrested this afternoon by City Detective Edward Cudihee and Dep- uty Sheriff A. J. Lans. Henry McLaughlin, a sailor, who wit- nessed the taking of Lyons’ life, has posi- tively identified the hotel man’s assassin. He says Berg did the shooting, and the officers declare that the man was killed with his own revoiver, and that the weapon was taken from the lodging apart- ments above tie saloon. 1t was in these lodgings that Berg and Moss ciaim to have been when the shoot- ing began. Two or three minutes after Lyons fell, mortally wounded, behina the bar, Moss and Berg walked into the place and took possession of the body and premises. They also notified the authorities of the tragedy. In the safe, money drawer and on the person of the desd man there was about $1000 in cash, none of which was dis- turbed. The officers find no trouble in aseribing a motive for the work of Moss, who, they believe, induced Berg to engage in the murderous scheme for the purpose of rob- bery. e the anadt dropped from Berg’s face, disclosing his identity, they weak- ened and became rattled and ran away without the money. Moss, it transpires, is a man whose life een pretty well steeped in crime. He did ten or twelve years' time in this State for shooting in the back, with in- tent to commit murder and robbery, a stockman, in 1877. On this occasion, also, he ran away without obtaining the money. His early days he spent in California, and the detectives are trying to run down a report to the effect that he servea a term in Ban Quentin. The father of Moss, who was a pioneer of Beattle at one time, contested Lyons’ right to the tract of land on which the building where the murder occurred stands. The elder Moss died and his beirs, in- cluding John H., the accused, took upthe fight, but were beaten in the courts, after which Lyons, - through sympathy ap- parently, gave each a small sum of money. Of late years, in his destitution, Moss, it seems, has been & pensioner toa cerian tent on Lyons, by whom he had been supported outright for several weeks prior to the murder. Berg is a carpenter, 34 yearsold. He resides in Seattle, where he has a wife and two children. Moss is unmarried. SAN DIEGO LITIGATION. Suit Brought to Set Aside the Recent Sale of Land and Town Com- pany Property. LO8 ANGELES, Cair, June 21.—The deal by which 8. R, Cheney and others were to obtain entire possession of the property of the San Diego Land and Town | Company is not to be allowed to gzo through without a struggle. A start was made to-day in what prom- ises to be a course of sensational litiga- tion. TIn the Unitea Btates District Court, before Judze Wellborn, there came to light & suit that was filed last Friday in the case of Mandell against the San Diego Land and Town Company. It was in the form of a bill of interven- tion, and came into court on a motion to allow proceedings under it, which the Judge took under advisement. The intervenors are George H. Hill and Frank Kimball, stockholders in the com- pany, who al scheme on the part of the officers to d the stockholders other than themselves and to get control of the. property of the company. The intervenors allege that a bill in equity brought by Cheney and Mandell was drawn irregularly and verified by John E. Boal, though™ he was general manager of the company, and that in consequence of the presentation of this bill to the District Court an order was obtained appointing Mandell receiver and ordering a foreclosure; that the prop- erty is worth $3000,000 and has debts amounting to $800,000; the claims of the Cheney family are $144,500, the validity of which has never been passed upon by any court; that at the time of the plication for receiver Cheney and ssociates had an option on the debent- ure bonds of the company; that the pur- pose of Cheney and others in applying for tbe issuance of receivers’ certificates was to fraudulently secure & priority of claim for their demands. The intervenors charge that the officers have not tried to sell the property, but have plunged into unnecessary debt. They allege that Receiver Lanning has depreciated the property’s value $250,000, and that the scheme is to buy the prop- erty in at a third of its value and make a profit of $2,000,000; that in line with this scheme the property was, on June 14, 1897, sold under foreclosure to B. P. Cheney for $889,163 33, The intervenors ask for the removal of Receiver Lanning. e Boundary Falls Hotel Man Killed. BPOKANE, Wask., June 2L.—James J. ‘White, proprietor of the Boundary Falis (B. C.) Hotel, met a horrible death on Sat- urday. He was drivinga team from Boundary Falls toward Midway, and when going down a !uer hill, within two milesof Midway, be lost control of the borses, A woodsman saw the team pass his cabin at a run, and shortly afterward saw White, who was leaning forward, fall over the front of the wagon. The wheels passed over his neck and head, causing such injuries that death resulted within two hours. When he was picked up he was bleeding from the nose and ears, and was badly cut about the face and head. He was unconscious and remained so until his death. 3 e First Wheat From Kings County. Y., June 2L.—A wealthy farmer named William Gardner was mur- dered and robbed in his bachelor home in the mountains near here on Saturday, and his body was found Sunday. To-day Joseph Decker of Plattskill was arrested for the crime. Decker, if he is the murderer, found the victim near his home and after killing him drove to Newburg with his horse and buggy ana about - everything else sed by the murdered man, where he spent two days disposing of his booty and spending the proceeds.
