Some Disclosures Concerning Some Proposed Compromises With Hos- tile Claimants Long Ago. Florence Blythe Hinckley and Thomas L Bergin, her former adviser in legal mat- ters, had another session of argument and testimony in Judge Hunt's court yester- day. Mr. Bergin thinks he has not received enough for his services and demands an extra $50,000. To this Mrs. Hinckley re- sponds that she has already agreed to give him 3 per cent of sll the Blythe estate secured to her by the decree of court that makes her the heir 10 the estate of Thomas H. Blythe, deceased On his part Mr. Bergin replies that he has not ye: been able to secure formal scknowledgment of 113 claim for the 3 per cent mentioned by Mrs. Hinckley. Her rejoinder is that her delay in effecting a settlement of that point grew out of the fact that Mr. Bergin had demanded ot ber this amount of $50,000, which she thought was in aadition to the sum that she thought she ought to pay. Of course all these allegations and in- ferences are not set out in the formal pleadirg filed i Judge Hunt's court, but they are facts that may be gathered in the course of the interesting disputations of the lawyers. Ex-Juige J. F. Suilivan, representing Mr. Bergin, stated yesterday that not only had his client been unable to obtain hisfee but that he was stili waiting for the repayment of any part of $17,000 that Her Correspondence With Mr. | $75.000 had been offered o the gypsy B | | | | { | | he had luid out for the support of Mrs. | Hinckley during the years that she was waiting for the recognition and confirma- tion of her claim to heirship by the Su- preme Court of this State. Hurt, managed to keep on fairly good terms with Judge Sullivan, but it was different with the other ex- Attorney-General. For instance, Mr. Bergin was asked about,a letter that Mrs. Hinckley wrote to him and an effort was made to have it introduced in evidence, 1t was read as follows: SANTA MoNICA, April 17, 1894. Of the services rendered in securing this result, I may say without vanity that mine was Dot the least meritorious: but for them there wouid be iittle to compromise over. I there- fore beg you to let me have the agréement as executed as requested by saturday ext. In making objections to the introduc- tion of certain’ evidence offered by the plaintiff, Attorney A. L. Hart said it was proposed to show on bebalf of the defend- ant that the firm of McAllister & Bergzin did very little service in the Blythe case during the trial i Judge Coffey’s court; that ~Mr. McAllister diea scon after Florence cams to this City and that Mr. Bergin was sick and not able to attend to business; for the establishment of these facts he would not call witnesses, but would refer to the terms of the contract ot 1892. It was in the Supreme Court where the case wus argued on appeal that Mr. Bergin did what 1s admitted to be good work for the Biythe estate claimant. Mr. Bergin is an entertaining witness. He is all the time telling something that the public likes to hear. Oune of his gems, dropped during yesterday’s proceedings, was in reiation to section 1664 of the Code of Civil Procedure. This section provide that a claimant (o an estate may institute an action to compel all the rest of the world to come into court and make a showing of their claims if they have any. When asked if he remembered when the law was passed Mr. Berein said: “Yes, I remember that law. Idrew that bill. It was prepared on my advice. A:ter I drew it vou took it to Sacramento and it was passe ] by the Legisiature.” Mr. Bergis was on the witness-stand all day, and it is expected that it will take another day for him to tell all he did to assist the littie girl who came from Lon- don in 1883 to become the sole heiress to the eetate of the late Thomas H. Blythe. Judge Hunt thought the plainiiff had a right to have as much of this epistle con. sidered in evidence by the jury as related to the issues on trial. Mr. Sullivan elic- ited from Mr. Bergin, who was on the witness-stand, that Mrs. Hinckiey called 1 ¥ on him at his office in accordance with her sugzestion in the letter from Bania Monica. “Why didn’t you get your contract signed then?” demanded ex-Attorney- General W. W. H. H. Hart—On the contrary, the proposi- tion was thiat he had been puid in full by 1 3 per cent 1o which he was entitied under hig origipal enzagement and coufirmed by tne contract of 1892. Mr. Suilivan: ferently. Considerable interest was shown by the jury in the reading of Mrs. Hinckley’s letter, for as a business-like exposition of her relations with her lawyers it would be hara to beat. There seems 10 be no doubt that she composed the letter away off down in Santa Monica, where she had no op- portunity to avail herseif of the assistance of her legal advisers, and if it is a fair specimen of her business letters, thers can be no doubt that the financial aviluy of old Thomas H. Blythe has been inherited by his daughter along with his real es'ate, Another letter on_ which Mr. Bergin placed considerable dependence was the following: My Dear Mr. Bergin: 1 have scen General Hart to-night aua had a talk with him about my cases com!ng up in the Supreme Cour: ou Friday next. Ishall of course expect you to take part, and shall feel disappointed if you do not. Palace, January 8, 1894. Covnsel for the defendant thought this showed nothing more than that Mrs. Hinckley expected Mr. Bergin to proceed with his contract. The following letter from Mr. Bergin throws some unexpected light on some of the inner workings of the Blytbe litiga- tion. It was presented to the court but was not admitted in evidence.
