A Tangle of Technicalities n Which Members Get Lost, SHARP PASSAGES THE DEBATE. IN Clinton’s 2nd Rottarz.’s Ord-rs Both Los'—Haskins’ Order Makes a Cut of $141,000 The Board of Supervisors held an all- day session yesterday with the purpose of fixing the long-debated water-rate qu tion, and finaily adjourned with the members under the impression thatt had not done so. The result was that both sides got tangled up in the mesbes, and when they ieit they left a record of having finally adopted a new ordinance, although they went home, most of them at least, under | the impression that the final step had yet to be taken. The mew order, which is now the law, was introduced by Supervisor Haskins after the Water Committee or Clinton or- der and the Rottanzi order had both be defeated. It makes a reduction all down the | households, meters and sh ping, in the matter of horses and cows, und takes_ off entirely the charges for | vehicles. At the opening of the session in the morning Dr. Clinton begzed leave to sent again the order recommended by Water Committee. The order went to a vote with lirtle discussion and was de- feated by a tie vote, Dr. Rottenzi voting against it. The reading of it was followed b motions to adjourn for a week, and for a day, but they were voted down. Clinton and Dodge complained that time was es- sential to an understanding of the new order. He said he had heard rumors that an order was to be presented against which the water company would not ob- ject. Haskins took exception to this re- mark and called him to order. It was inally agreed to take a recess until 2 o’clock. At 2 o’clock,-when they reconvened, Dr. Dodge nad prepared a scheduie of the per- centages of the reductions provided for in the new order on household rates. He had them all figureda out on a biackboard, which was pluced on the chairman’s desk, the chairman taking his seat below with the cerk. Dodge had presided at the morning session. as they sat in commit- tee of tne whole; but Britt was called to the chair in th- afternoon, as Dr. Dodge wished to explain his figures. He took bis piace on the platiorm and argued at lengih from the figures as presented that the cut did not cut. He said that the reductions provided were heavy in that class of buildings that were few, ranging as high as 16, 18 and even 23 per cent. On the ciass of buildings that were mosi numerous, how- ever, and which represented the greatest revenue to the company, the cut ranged down to 6 per cent. He did not believe the cui represented any cut at all of the company’s revenue, as it 100k no account of the increase of business, which amounted 1o $90,000. The matter was discussed all the after- noon. Haskins explained that bis order represented a general cat in ail depart- ments and would reduce the company’s revenue fully $141,000, The opposition asked for more time, but the friends of the order insicted that the ume had come for action, as fully five months had been taken up in ihe dis- cussion of this matter. Before it came to a vote Clinton offered ®s an amendment another order on the lines proposed by Rottanzi, but this was voted down, and the commitiee adopted or agreed to report the Haskins ordinanc The committee then rose, Mayor Phelan took the c.airand the body organized as the Board of Supervisors for.the last act. Upon motion the order was considered b; paragraphs and by paragraphs it w. adonted. Dodge, in voting on several of the para- graphs, voted with the majority, giving notice taat he would move fur a reconsid- eration at tbe next meeting. This caused a long discussion as 10 his right to do this. The chair ruled that be had the right, and tuat the action on any paragraph carried with it ihe whole order. Lackman here asked a question that precipitated a long cross-tire. He wanied 10 know if the Sprinz Valley would accept this order, there had been so much talk about their appealing to the courts. Britt objected to the question being put to its representaiives, but withdrew the opposition, and Mayor Phelan asked Mr. Kellogg, who was present, for an answer. He-said that he would not be ‘‘fore- closed’’ on such short notice. They would ‘have to siudy the order. The company, he said, was now compelled to sell 8000 shares of stock. To force the company to pay only 5 per cent on the stock would be to depreciate it so that they could not raise the money required. 1hey would pay 6 per cent in auny case if other re- trenchments had to be made. Motions to suspend the rules in order . sation to be collected by Britt, at ten minutes past 5 o’clock, moved to adjourn until hfteen minutes after 5 o’clock in order to meet the condi- tion of ‘‘the meeting,” when he thought the consideration might be properly called up. 3 The motion carried, but Dodge objected. He said the adjournment was not an ad- journment, but a recess. 3 The chalr sustained him, holding that a legislative body could not, techbnically, bold more than one session one day. After a great deal of talk an appeal was ken by Britt from the decision of the chair, and the chair, by the old vote of 7 10 5, wasoverruled. A motion to adjourn | was then made and carried. : By the vots overruling the chair Clerk Russell declares the board decided that it was holding a second meeting, and that Mr. Dodge had the opportunity of mov- ing for @ reconsideration. As hedid not | do so, Clerk Russell says, the record in- dicates that the order stands adopted. Prevention of waste or excessive use—In no case here the fixed rates above provided, other than meter rates, are appli- cable, shall any charge for water be made by meter rates, it being the purpose of this reso- lution to provide for ail dweiling-houses a fixed monthly rate, which shall not be in creased by tiie person, company or corpora- tion supplying water. Provided, however, that for the purpose of discovering and repressing waste or exceseive use, all persons, companies or corporations shall have the right in all cases to appiy and maintain meters to measure the water nused or consumed. and to charge and coliect for waste or excessive use under the condition wnd to the extent hereafter provided in this section and not otherwise.
