Whitney Dis- missed by Judge Camphell for Lack of Frosecution A charge of selling aduliterated currant jelly against A. L. Whitney, wholesale commission moerchant, Davis and Sacra- mento streets, was summarily dismissed in Judge Campbell’s court yesterday after- noon. The case was fir:t called last Thursday, and, at the request of the defendant’s at- torney, the Judge gave a verbal order to the prosecution to provide the aefense with a sample of the jelly to be analyzea by Professor Price. The case was acain called on Saturday, w.en defendait’s attorney siated that the Board of Heal:th had refused to xive a sample of the jelly for analysis. Inspzctor Dockery, who wa< present, suggested that the order bs maie in writing, which was accordingly done. Yesteruay afternoon the case was to be tried by a jary, and, after ihe jury was | impaneied, Pro-ecuting Atiorney Spinetti | read the complaint and opened the case, Tne deferdant's attorney court th informed the t the Ju!ge’s order to provide a | sample had not bee obeyed. None of the witnesses for the prosecu- tion, Inspector Dockery, Deputy Inspector Hurrigan and Professor Werz+11, answered 1 their names when called, and the Judge instructed the jury to acquit the defend- ant, which was done. “The witness:< for the prosecution,” said the Judg-, “are not here, although the cas was uefiniwaly set for trial. They have refused 10 obey the order of the COuTt to ive a sample of the jelly to the detense for analysis, whioch should have been obeyed in justice to 1he defense, I am not here for the prosecution or de- fense, but to see that justice is done in the premises, and in the circumstances I have | no other recourse but to instruct the jury todismiss ihe case.’’ oo o el D Ul MRS. REAL ESTATE Much Capital Seeking In- ves‘ment in Downtown Property. Two Important fales in the Whoesale and Retail Dis- tricts Reported. Bds Rceiv d by Collector W se for the Ciearing of the Ground for the New Postoffice. The totals of another month's business show an improvement in ihe raal estate market as well as in the building trades. This is brought about in the first place by the ineclination of strong capital to secure good investments on the main thorouzh- fares, whi¢h has bzen followed, as usual, by investments in smaller properties. Im- proved real estate showing a good earning is in fair demand and can be sold very close up to the full market price. The de- sirability of modern places of business and up-to-date residences has brought a de- mand for the better class of vacant prop- erties. T.e immediate outlook for reaity affairs is certainiy quite promising. No doubt better times is that the owners of prop- erty generally are inclinez to fall in with the tide of improvement which seems to be in the . It has been shown very clearly that where property-hoiders are prepared to improve their streets and put their property iu order a market can be created, as the projerly in this manoer be- comes available for improvement, which leads finally 10 an income. For years the writer rolled and tossed on the troubled sea of sexual weakness until it was a questiofi whether he had not better take a dose of poison and thus end all his throubles. ~But providential inspiration eame to his aid in the shape of & combination of medicines that not only completely restored the general health, but enlarged his weak, emaciated parts to natural size and vigor, and he now declares that any man who wiil take the trouble to send his name and _address may have the method of this wonderful treatment free. Now, wwhen I sey free I mean absolutely without cost, because I want every weakened man to get the beaefit of my experience. Iam not a philantnropist, nor do I pose as | an enihusiast, but there are thousands of men suffering the mental tortures of weakened manhood who would be cured at onga could as the one that cured me.
