Says He Has Systematicaily Falsified the Accounts of the Undertaking Business. Thousands of Dollars Alieged to Have Been Unlawfu!ly Diverted to H's Coffers. Annie B. Gallagher, by her attor- Sullivan & Sullivan, has instituted a suit sgainst Hugh B. McAvoy and Ernestine Gallagher, executrix of the es- tate of Henry J. Gallagher, deceased, for an accounting. Miss Gsllagher is a partner in the un- dertaking business of McAvoy & Galla gher at 20 Fifth street. She alleges that she and her brother had always had the greatest confidence in the honesty and in- vegrity of McAvoy and permitted him to take full charge of the books of the firm. A suspicion of dishonesty never crossed their minds, and so the books Were never given even a cursory examination until aiter the death of Henry Gallagher, when it became necessary to balance them to ascertain the value of his interestin the firm, The complaint says that it was found | that McAvoy's frauds commenced in May, 1887, one year aiter the partnership was formed, and bave continued ever since. By meins of faise jootings he had been able to appropriute $13,800 belonging to | the firm. ] Miss Gailagher also charges that _MC-! Avoy has defrauded the firm of varions | other sums in other ways, but the amount | is notknown. He execuied the note of | the firm in favor of the Dononoe-Kelly Banking Company for $2000 and appro- priated the borrowed mouney to hisown use: Miss Gallagher elways employed a man 10 look after her interests 1n the firm, but discharged him & short time ago. He was immedlately employed by McAvoy, who refused to permit James Suliivau, Miss Gallagher's newly employed representa- tive, Lo see the Dooks or look after her in- | terests in any way. Miss Gallagher alleges that the stock | and fixtures of the firm are worth $45000, | and that there are outstanding accounts | to the value of $20,000, while the firm has debts amounting to $16,000. | It isalleged that proceedings in insolven- | | cy are about to be commenced and that Mc- Avoy is not able 10 pay his share of the debts. The plaintiff asks that McAvoy be com- pelied to account for the profits of the business; that he be restrained from in- terfering with the business of the firm and that a receiver be appointed. | John L. Buckley was appointed re- ceiver and the restraining order issued as | prayed for, preventing any iurther trans- | fer of property interes.s one way or an- other. Last Monday there was placed on rec- ord a mortgage of $1750 given by H. B. McAvoy and wife to the California Casket Company on the property at the north- west corner of Broderick and Waller streets, On the samne day Mrs. McAvoy filed a declaration of homestead on the same property, valuing it at $5000. Miss Gallacher alleges tiat the false entries by McAvoy will amount to $13,800, but she is unatle to ascertain the extent of bis other fraudulent transactions. The taxvayers and property-owners on the line of the San Bruno road w_ill de- mand from the Supervisors a portion of next year's appropriation for lights and hydrants. They want them placed from Army street along that portion of the road where the houses are numbered. It is claimed by those who live in that section that they have been neglected for a number of gears, no provi- sions having been made to protect their homes aganst fire. The Spring Valley Water Company has ignored that section in its distribution of water mains, al- though the pipes which supply the City with water run within a :ew hundred yards of the roadway, and the work of ex- tending & side main to any oneof the many elevated mounds adjacent to the valley would ental but a trifling ex- nse. A similar neglect is attributed to the gas and electric company in not extending its pipes or conduits in that direction, and as a result the people living out there might as well be located in Alaska.
