Damages in the Sum ¢f $50,000 ani a Perp:etual Injunciion Demanded. A complaint has been filed by the “Aktienbrauerie zum Lowenbrau in Munchen” against the San Francisco Breweries (Limited) for §$50,000 damages, it being alleged that the local concern has uniawfully imitated the product of the plaintiff, selling the same to the public as the genuine article—a cerfain beverage calied Lowenbrau, wkich being translated means *‘Lion beer.” The papers in the cause set forth that the plaintiff is a resident of the city of Manich, kingdom of Bavaria; that it con- ducts all its business in Munich and bas never had any business agency or repre- sentative in the State of California, in any of the Pacific Coast States of the United States, and was ignorant and unaware of the fraudulent practices of the defendant here mentioned until nine months ago; that since receiving information of the fraud, with intent to stop such unlawful acts if possible, the plaintiff has been en- deavoring through its empioyes and busi- ness correspondents in various parts of the country to obtain evidence of such fraud- | ulent acts; that said acts are being con- cealed by the defendants, and that by rea- son of said concealment the plaintiff was compelled to spend about seven montbs in procuring evidence sufficient to verily | he allegations of the plaintiff herein set | forth, and that on securing the necessary information the present action was brought with all convenient dispatch. Alter reciting these matters, the plain- 1iff, by Attorneys Loewy & Gutsch and J. M. Nougues, asks for a judgment of court perpetually enjoining tiie defendant | from exporting, se.ling or offering for sale, under the denomination of “Lowen- | braw’ or “Lowenmbrau Munchen,” any beer or beverage manufactured by the defendant or ‘eny other person or firm other than plaintiff herein; from coun- | terieiting, duplicating or imitating in =ny way whatever the plaintif’s trade mark and applying such counterfeit in any manner 1o any beer or beverage other | than the genuine “Lowenbrau’; from | using or appiying o any bottle or other vessels containing any beer or beverage other than the genuine ‘“‘Lawenbrau’ any marks or labels so closely resembling | tie plainuff’s trademarks or labels as io i be apt to lead the public into the belief that such mark or labels are those used by the plainiiff; from packing any spuri- | ous product in bottles, boxes, etc., such as | are used for packing the genuine “Lowen- | brau,”’ or doing anything to deceive the | publicinto the belief that said spurious produet is the genuine *Lowenbrau.” In addition to demanding $50,000 dam- ages and perpetual injunction, the plain- 1iff asks that the defendant berequired to account to the plaintiff for and to pay | over to the plaintiff all the profits which | the defendant may have derived from the manuiacture of said bogus beer under the name of *Lowenbrau” or under said imi- 1ation trademark or labels. On reading and filing of the complaint and the approval of a bond for $1000, Pre- siding Judge Seawell issued a temporary restraining order enjoining the defendant and its employes from doing sny of the acts complained of. show cause why the injunction asked for should not be granted. THE SYMPHONY CONCERT A Crowded Hous: Greets the San Francisco So ciety. Miss Gertrud: Au!d-Thomas and Hugo Mansfelét Do Excellent Werk The San Francisco Symphony Seciety’s fourth concert was a decided success. A Jarge and fashionable audience was pres- ent, despite the gloomy and unsettled state of the weather, and from beginning 10 end every one was well pleased. Miss Gertrude Auld-Thomas sang Myer- beer’s “~hadow Dince from Dinorah’” in he: usual deligbtfal manner, receiving a perfect storm of applause. Raff’s Piano Concerto in C, played by Hugo Mansfeldt, was well received. Suite *‘Les Erinneys,’’ by Plassenet, was perbaps thie most beauti- ful number on the programme. The sec- ond movement, *‘Scene Religieuse,” with the "cello obligato by Lou:s Heine, and the “Danse Grecque’’ of the fourth number, were enthu.iastically encored. Schumann’s “Overture Genoveva” aund Trendsen’s the programme. The next concert, which will be given May 1, will be devoted to Wagner. Tuere will be the quintet from “‘Die Meister- singer,” the duet from *‘Lohengrin’’ ana “Isolden’s Liebstad.” The following art- ists will appear in conjunction with the S8ymphony Society: Cecelia Adler-Kees- ing, Kuherine Fleming-Hinrichs, Ma- thilde Wilde, Alois Werner, Rhys Thomas and Jacob Mueller. Owing to the ex- treme length of the programme the con- cert will begin at 3 o’clock sharp, ————— ARRESTED FOR MURDER. Hoey Si Yik Charged With Killing Lo How Last December. On the 28th of December the body of Lo How was found hanging by a cord to' a raiter in a small vacant stable in the rear of 826 Stockton street near the build- ing of the Chinese Consul. At first it was believed that How had committed suicide, but upon the body being examined at the Morgue @ large builet hole was found back of the right ear showing that be had been murdered. An investigation by the police brought to light the fact thata few nights before there had been a terrible row among the Chinese who lived in the house in front of the stable. Daring the trouble How was murdered and his body throwr into the back yard and then sus- pended to the rater. 2 The dead man’s beddmf and effects were burned on the sidewalk, and before the crime was discovered the house was vacated. The murder has remained a mystery to the police. The case was not abandoned, for Officer J. W. Capels and How’s cousin, Young Chang, have been steadily at work trying to get'on the track of the murderers, - The first result was On the 2d of next| month the defendants are required to| warrant charging Hoey Si Yik with murder. He 1s said to have been one of the persons who were present and partici- peried in tue ficht on or ubout Christmas night in which How lost his hife. Yik was arrested vesterday by Officer Capels. 1t is likely that several arrests wiil follow. THE QUAJKENBUSH FIGHT. In the Probate Court The Lady De- mands Half of Her Contract Hus- band’s $750,000 Estats. Mrs. Nancy Abboti Quackenbush, by her attorneys, Rodgers & Paterson, has filed a contest to the probate of the will of Thomas M. Quackenbush, deceased. The estate involve ( is worth $750.000. Mrs. Quackenbush bases her contest for half of the property on the ground that she is the surviving widow of the deced- ent, and declares that when he signed a paper purporting to devise his estate to his daughter, Mrs. Esther E. Sworttiguer, he was not of sound and disposing mind, and was not mentally competent to exe- cute & valid wiil Alle :ation is further made that at the time of the alleged execution of the will the deceased was under tne influence of Mrs. Swortfiguer, who is named as execu- trix and principal devisee; that he was coerced by her, and by threats, menace and fraud, compelled to sign the said al- leged will. Some time ago Mrs. Quackenbush sued the late Mr. Quackenbush for $500 a month as permanent support, claiming to be his wife by virtue of & contract mar- riage. Several experts in handwriting exam- ined the contract presented by Mrs. Quackenbush and declared that it wasa fabricated paper, testifying that the sig- nature was genuine, but that the original writing was an order for goods, and that after such writing had been erased Mrs. Quackendbush had written in what pur- ported to be a marriage contract. After hearing all the testimony Judge Seawell held that the experts were mis- taken; that the signature of Quackenbush was genuine and that he knew what he was signing, but that Mrs. Quackenbush had no legal standing as a wife, for the reason that there haa been no assumption of marital rights and duties of the parties, as required by tne law of Calhifornia. Through the new suit the entire matter will be gone over again in Judze Slack’s court.
