Interests o Attorney Hart, Gar- ar, Bualt, Bishop, Foote and Kowal'sky “Grandma” Perry's Demand for Ex- tra Comp:us-tion Wili Be Ob- stinately Contested. The suit of Mrs, Florence Biythe-Hinck- ley against the lawyers and others en- gared and interested in the Blythe es ate litigation has been assizned to Judge Seawell of the Superior Court for trial. It is intended by this action to determine the rights of the different parties tnat bave figured in the case. Briefly stated, Mrs. Hinckley seeks to have a settiement of the claims held by others against the $4,000,000 estate which she inherited from her father, Thomas H. Blythe. That it is in some degree a friendly suit is apparent from the fact that her attorneys are W. H. H. Hartand Ayiett R. Colton, while W. H. H. Hart is the first defendant named in the com- plaint. The creditors are: Louis P. Drexler, $60.000; George E. Bates, 22,500; L. I Fish, 8665 11; Caroline A. 1,000; Ehzabeth 'A. Rodgers, Towne, To Messrs. Garber, Boalt, Bishop and Foote Mrs. Hinckley has already trans- ferred one-fiitieth each of the properiy known as the Blythe block, and she does not dispute their title in this regard. Emma Joseph holds a mortzage on the property for $49,000, Thomas I. Bergin has claims amounting to $66,179 5¢ and John D. Eaton demands $25,000 he claims of the iate Hall McAllister and of his representatives, as well as the claims of Thomas I. Berwin, are resisted by Mrs. Hinckley on the ground that when sbe signed the contracts to pay them 714 per cent of all property awarded to her she wasyoung and inexperienced, and was led by her guardian to believe that she was legally oblized to do so; fur.her, that she had no independent advice in regard to the same. She alleges that McAliister and Bergin faied to perform the services they agreed to periorm, and she objects to paving their claim. | Touching the compensation for her guardians, the late James Crisp Perry ana Kaie C: Perry (now Mrs. Byrne), it 1s ad- mitted by Mrs. Hinckley that sie agreed to pay them 10 per cent of all properiy recovered by hLer, and she insists that this thall e considered in tull for all the ser- vices of ber guardians. She savs she has paid Mrs. Byrne (formeriy Mrs. Perry) $19,450. Several of the defendants named pre- tend to ho!d interests in the Bivthe estate obtained under and throngh Mrs. Byrne. Mr. Perry was her grandfather and Mrs. Perry was her grandfather's second wife, Mre. Hinckley says that when she signed the second contract agreeing to pay Mrs. Perry-Byrne additional compensation she did so under a misapprehension of her rights. She thinks the original 10 per eent is encugh for Mrs. Byrne. Mrs. Hinckley admits that on Maren 8, 1892, Henry L Kowalsky obtained from ber a writing by which she agreed to transfer to him 2 per cent or one-fiiteieth of all property recovered by her from the esiate of Thomas H. Blythe. Since then she has paid him $8165 95 and has accepted an order from him in favor of Joseph E Shaw for $2750. She has also received notice that Mr. Kowalsky has transforred 10 per cent of his ore-fiftieth shareto J. H. Mahoney. There are otlier creditors of Mr. Kowalsky wio are included in the list of defendants in order that theirrights may be adjudicated. The interest of W. F. Goad in the mat- ter is represented by a loan of $10.000 to Mr. Hart. The claim oi George P. Goff she repudiates altogether. In conclusion, Mrs. Hinckley represents 1o the court that the real estate sought to be partitioned is susceptible of being di- vided and partitioned to the persons who own interests therein, and she asks for an order of court making such partition in such a manner that the share to which she is entitled shall be set apart in one body. An early hearing of the suit will be asked for by Mrs. Hinckley and all others interested in the matter. Only four con- tested claims appear in the record, and it is thouzht that a decision may be reached in regard to the nndisputed ciaims, and a division of a portion of the Biythe biock | will be effected as to such claimants. The other matiers will be left for subsequent Iitigation. FRATERNAL EVENTS. First Entertainment of Mission Chap- ter, 0. E. 8. —The Progressive Guild’s Anniversary in Golden Gate Hall, Nearly three hugdred ladies and gentlemen were in Mission Music Hall at Twenty-first and Howard streets last night to enjoy the first en- tertainment given by Mission Chspter, U. D., of the Order of the Easiern Star. which was in- stituted on the 19th of last December. The entertainment off-red embraced some novel features that offered a great deal of amuse- ment, and shows that the new chapter is of the progressive kind, and thorougbly up to date. The affair reflected great credit on Jobn A. Wilson, Mary G. Foster and Jumes W. Key- ston, the commitiee of arrangements. The first number was an iustrumental solo. ‘This was followed by an origina! sketch, enti- tied “The Counter Movement.” in which the following named took pert:_ James A. Wilson, Henry L. T 'ndered “Way Down Upon the Swanee River” with more discord than was ever heard irom any four voices; S:m Booth sang *“Locked Out” with his usual bumor; Mrs. Lida Hickok ve a recitation; Miss Mabe ie Holbrook gave c violin svio; Mrs. McCrriney sweetly sang “Teil Her Thet 1 Love Her S0”; Miss Cordie Wetjen,a charming whistler, gave an exiiibition of her abilily; the Mission Lodge quartet, J. The floor was then cleared for dancing, which was kept up until midnight. Theré were present several of the grand oficers and members of chspters in this City and in Oak- laig. There wes & large ettendance—nearly 500— at the first anniversary entertsiument and ball given by San Francisco Chapter of the Progressive Endowment Guild of America in Golden Gete Hall. The hall was decorated with exquisite taste, aud the programme pre- seated was one of unusual excelience. After an overture, M. T. This Important Thuroughfare Will Be Graded and Bituminized. The Richmond peovle with but few ex- ceptions are delighted over the prospect of getting First avenue, from the military reservation to the Golden Gate Park, paved with bitumen. Itis the h of the residents of this favored section to have this thoroughfare declared a boulevard as soon as it is put in proper cond:tion. To that end there is a petition now before the Bupervisors to lop off three feet from each of the side- walks, which wiil be added to the width of the street, thereby leaving the walks seventeen feet wide, which is considered amuole for present and iuture use. This besutiful boulevard will, when compiete, make a continuous driveway not only from the Presidio, but the en- tire northern district, to and through the park. In aadition to this boon the south- ern boulevard on Seventh avenue, which has been graded by Captain John Tuttle as far as M street, will lead direct to Inglesice race course. A portion of this avenue stiil remains to be graded, but from present calcu.ations this work will soon be done, as it is contemplated to put the unemployed men who now desire work on the job. The opposition of a few of the property- owners to the impreving of First avenue Las been overcome by the urgent neces- sity of repairing this, oneof the most important outlets to the R.ctmond. The Presidio Heights Improvement Club has been urging the grading and paving of First avenune for a number of years, but the last Board of Supervisors turned a deaf ear to its wishes in tnat di- rection. But now the members of the club, together with the Point Lobos Ciub, congratulate themselves on getting what they have been contending for. ———————— Embezzlor Mctioy Goes E Charles B.
