The Ex-Judge Accuses the Other of Fixing a Member of the Jury. Acrid Recrimination Eventua 1y Winds Up in Mutual Expressions of Apo'ozy. There was quite a heated discussion yes- terday between Major Smith and ex-Judge Louderback in Judge Joachimsen’s court. Atturney Smith is defending some 250 Chinese, arrested a week ago last Satur- day in dens about Chinatown. Louder- back is the special couasel employed by .Chief Crowley for the prosecution. The trial of these cases has caused both Attorney Smith and Joseph Coffey, his associate, to be placed in contempt, with a fine o1 $100 and imprisonmeut in the County Jail to be held over their heads. Miss Mary Mootry showea great imp: tience whiie on the witness-stand in Judge Coffey’s department of the Superior Court yesterday. She accused Henry A. Crane, executor of the will of Thomas Mootry, deceased, and his attorney, M. Mullany, of having prevented her from serving s executrix of the estate of her brother, the late Thomas Mootry, and complained that Mr. Crane had been allowed $3000 and Mr. Mullany $2000 out of her brother’s estate for their management of the estate’s affairs, when she thought 1t was worth no such sum. Atrorney Deal, representing Miss Mootry, introauced figures to show that the in- come of the estate had been $5134 and that Messrs. Crane and Mullany had taken $5000 of this sum. £ “They wanted a great deal more,” said Judge Coffey. “Mr. Crane even said he wouldn’t do the work again jor $5000. I don’t think he gave anything like a quar- ter of his time to the affairs of this es ate. I told him then as I tell him now that he was not compelled 1o accept the office of executor any wore than Iam competled to accept this office where I get only $4000 a year for all my time. Yet he appraised his s rvices at that high figure.” Miss Mootry was much moved. She testified that when she came here from New Yorx City afier her brother’s deatn she wanied to ree the Juage of the court, but Mr. Crane warned her that Judge Cof- fey was a very unapproachable man, and consequently she debarred from her rights as an executrix of her brother’s es- | tate. She was eiven no information and The habeas corpus writ sued out by them resulted in their being remanded to jail, but they have managed {0 havs execution | was not even told when the final account | was to be presented to the court, so that | she could be present and see whare the | money was going. She said that Mr. Mul- ‘suming too much [ " words so as to prevent us getting in our of judgment withbeia while the cases of their Chinese clients are before the court. It was the trial of Wong Lung, a visitor to a gambling game, that came up yester- day._ The evidence was the same as given | lany had also attempted to keep her from acting as executrix. Judge Coffey said it was apparent that Mr. Crane’s acts had kept Miss Mootry | from the enjoyment of her rights in the in other cases of the kind, and was con- | premises, and he thought she was entitled clusive enough for the jury to fin¢ the defendant guilty, During the argument made by the prosecution Attoriey Smith arose and de- clared that: “Judge Louderback is con- time. Judge Louderback immediately fired back the brand that created the trouble. udon’t want an argament made,’ because you have a juryman | “Yor ney Smith blanched. He squirmed in his chair and started to stutter an an- swer. His first words were forcible enough, but did not reach the ear of the | court. Then, having given vent to his pent-up passion, he adaressed ex-Judge Louderback personally, . pointing his ger at the person addressed. You, sir, say that I have a juryman in this box ‘tixed.’” You are not speaking | what is trge, and it I had you outside of this courtroom I wouid brand its falsity upon you in a manner entirely different.” “Tat, tut, tut!” interposed Judge Joachimsen, “‘1 want none of that talk in this court.” My honor is impugned,” broke in At- torney Smith. ‘I never bsfore have been accused of ‘lixing’ or tampering with a jury, and 1 certainly have never been ac cused of being ‘fixed’ while on the benech.” The intimation that ex-Judge Louder- | back had lent a willing ear to_defendants while he presided over one of the Police | courts some years ago was not taken up. | Aifter Wong Lung had been convicted louderbuck and Smith met in the corri- | dor outside the courtroom.
