NOW FOR THE GREAT FIGHT OVER THE FAIR MILLIONS The Struggle Between Mrs. Craven and the Bonanza Estate Interests to Open This Morning, AN ARMY OF ATTORNEYS INTERESTED. Some of the Peculiar Aspects of a Famous Piece of Litigation. PROMISES OF SENSATIONS IN| NUMBER. Ths Story of Two Wills *nd Their Bearing on the Famous Pencil Deeds, ‘What promises to be the most interest- ing lawsuit in the history of the State will open before Judge Slack this morn- ing—at least, that is what the court pro- gramme calls for. It is the fight between Mrs. Nettie R. Craven and the Fair interests for the pos- session of property which the principal of the Mission Grammar Schoo! lays claim to under the famous pencil deeds. The case comes up in the nature of a suit to quiet title between Mrs. Craven and the special administrators of the es- {ate of the dead millionaire, although in the background are other interpleaders, ejectments and many other such things that go to complete the complicated liti- gation that has surrounded Fair’s millions since his death. The value of the stake is about $1,500,000—quite a snug sum as things go, even in this country of big wealth. \ The property Mrs, Craven claims con- sists of the lot and the big five-story building on it on the southwest corner of Pine and Sansome streets and a half block on M ssion street, between Eleventh and Tweifth. The deeds under which Mrs. Craven asserts her ownership to this for- tone in land and buildings bear date Sep- tember 27, 1894, and were acknowledged by ex-Notary J. J. Cooney. The dogu- ments are wriiten in leadpencil, even to the signatures of Fair himself. The case that is promised this morning is, of course, lezally speaking, confined strictly to issues involved suit 1o quiet title, but undoubtedly there will be echoes of other and more interest- ing subjectsin the evidence. bledocument that the Fair children and their attorneysonce swore was genuine and afterward swore was forged—must of necessity stalk in the background, for this will and the deeds are more or less insep- arably related. Then there is Mrs. Craven's contract of marriage toJames G. Fair and the trust will to be beard from. The story of tte pencil deeds is an in- teresting chapter in the strange character of James G. Fair. Mrs. Craven at the time of their date was living at 2001 Caliiornia ~treet. The milliosare and she were intimate frisnds for years. Sep- arated from bis family, the lonely old man of money was wont to seek in o:her places the home he could not find for his own. He had been a frequent caller on Mrs. Craven—her marriage contract bears date May 23, 1892—and on the aiternoon of Sep- tember 24, 1804, be was a visitor at her hcuse. It was rather an eventiul time for the millionaire, apparently, for he ma ‘e history in wilis and deeds 'that day that has kept lawyers and courts since busy studying it. -The pencil will was written on that afternoon in Mrs. Craven’s parlor in the resence of the mistress of the house and Mrs. Blizabeth Haskins. The deeds he must have drawn up previously, for when he was through wil-making the bonanza king drew the documents from hs pockets and handed them to the woman who declares s: e was his wile by contract. Subsequently they were returned to Fair for acknowledgment, and this is the part Notary James J. Cooney takes ia the drama. Three days later the millionaire called at Cooney’s office 1n the Lick House and formally admitted that it was his signature. Fair died December 23, 1894, and left as 8 legacy an estate valued at $16,000,000. There was & trust will in the hands of Attorney W. K. Goodiellow, dated Sep- tember 21, 1804, three days anterior to the day of his visit to Mrs. Craven's house on California street. Under the terms of this will these millions were left in the custody of W. R. Goodfellow, Thomas R. Crothers and James S. Angus in trust for Mrs. Herman Oelrichs, Miss Virginia Fair and Charles L. Fair. The ftrust phase of their inheriiance was not to the liking of the heirs. In fact, from the day 4his will made its appearance their attor- neys began to mature plans to fight it. Legal storms began to gither on all sid About a month after Fair's death Mrs- Craven made public the fact that she was the guardian of the pencil will. This document bequeathed the property in three equal parts outrigiat to the children, and was.received by the attorneys and. heirs With open arms. In it they saw a deliver- -ance from tlfe hated trustdocument, and “ the fixht developed into a contest between the twG wills, and the Fair children and the trustees named by their father. The trustees raised the cry of forgery :‘and -fraud. The children aaswered that .the new will was genuine, and intimated conspiracy and undue influence on the part +_sof Goodfellow, Angus and Crothers. Mrs, Qelrichs and ber sister and brother fol- lowed this up with a formal protest against the trust document, and asked the court to admit the pencil wiil to probate. - The existence of Mrs. Craven's deeds was made known at this time to the attor- neys for the heirs. It was her wish to es. yin the case. and an agree- - ment was arrived at, waking Richard V. Dey, one of the executors of Mrs, Fair's will,an arbiter of her claims with power to pay her $500.000 in settlement. This was the state of affairs atthe end of the first year after James G. Fair's death. A decision by Judge Stack on February 3. 1896, that the trust clause of the Good- fellow will was invaiid was the means of completely changing the aspect of the famons case. Charles L. Fair immediatcly withdrew his opvosition to the document. This transfer of allegiance was followed by a declaration that the pencil will was a “forgery. Mrs. Oelrichs and Miss Fair made a similar change of front, and the agree- ment to settle Mrs. Craven's claims for $500,000 was repudiated on the grounds -that both the will and the deeds were ..spurious. This was Iollowed by the womax’s business agents putting the docu- ments on record, and her own startling declaration in court that she had a con- tract of marriage to the millionaire. Then fotlowed voluminous hearine of testimony from all the principals in the famous case. Mrs. Craven, Miss Craven, Mrs, Oelriche, Miss Fair, Charles L. 'air, attorneys and witnesses on each side were in turn called upon to tell their stories. The withdrawal of the Fair children from the support of the pencil will left Dr. Marc Levingston, who was one of the execators under it, as its only friena. in a plain | The ghost | of the famous pencil will—that remarka- | When the trial on thisq document was reached Levingston hauled it out of court, leaving the batile straight between Mrs. Craven and the Fair people over the pencil deeds. This is the manner in which the case comes up this morning. The charees against the deeds are that they are forger- ies. To this end ycung Fair has already had Notary Cooney, who acknowledged them, arrested on a_ charge of peTjury. The services of Daniel Ames and Dav.d N. Carvalho, the famous New York ex- perts, have been engagea to back up the charge of forgery. On Mrs. Craven’s side is her statement that the deeds are genuine and the word of Mrs. Haskins, who wat rraxent when Fair made them, and that of Cooney, who swears that Fair acknowiedged them be- fore him. These of course are but the principal witnesses. Behifid these aro others in great number not yet known on either side with their accompanying promises of sensations and startling de- velopments. The ca<e will be tried by a jury. For Mrs. Craven appear Attorneys D. M. Del- mas, 8. M. Shortridge, W. W. Foote, 8. C. Denson and J. J. de Haven. The burden of the fight for the Fair people will fall on Garret McEnerney, W. M. Pierson and R. B. Mitchell as ihe attornevs for the administrators. The Fair children, whose interests are identical with the adminis- tra ors, will be represented by George A. Knight, Charles W. Heggerty, Reuben Lloyd, Russeil J. Wilson, Mountford S. Wiison and Charles L. Wheeler. All in all. it promises to be a lawsuit that will eclivse the £haron case in dramatic in- terest.
