Attorneys Lyons and Dwyer - Quote Antagoaistic Code Provisions Thousands of Doliars Invelved in the Question of Collateral Inheritance by a Legitimate Child. Argument in the J. Vicente de Laveaga estate was opened in Judge Coffey’s court yesterauy morning by Attorneys Lyons and McEnerney, representing the recos- | nized heirs of the deceased, while Attor. ney J. J. Dwyer spoke for Anselmo de Laveaga, who claims to be the natural son of J. M. de Laveaga. The estate amounts to about $900,000, and there are five claimants, including young Anselmo. Anselmo was recognized and adopted by his father and legitimated in the mos solemn menner. It is acknowledged*on all hands that the adoption of Anseimo by his father is complete and indisputable under the laws of this State, so far as the rights of the young man to inberit from his father's estate is concerned, yet Messrs. Lyons and McEnerney argue that he bas no right to inherit coliateraily from his uncle Vincente. Addressing the court, Mr. Lyons said: it res no argument to show that A mere reading of the stat- ient 10 establish our position.”” Thereupon Mr. Lyons read section 1387 of the Civil Code of the State of California, which so far as it pertains to the matters involved in this litigation, provides: Every illegitimate child is an heirof any person who in writing, signed in the presence of a competent witness, acknowledges himself 10 be the father of such child. Mr. Dwyer returned a8 Roland for his Oliver, and read section 230 of the Civil Code, which says: The father of an illegitimate child by pub- licly acknowledging it as his own, receiving it 8s such with the consent o1 his wife, if he is married, into his family, and otherwise treat- ing it as'if it were a legitimate child, thereby adopts it as such, and such child is thereupon for all purposes legitimate from the timeof its birth. Mr. Dwyer was not so positive in his as. certion of his posicion as Mr. Lyons had been, but he intimated that he thought that the lawyers on the other side would have a hard time sweeping away that pro- vision of the code which makes the child thus recognized “legitimate for ali pur- poses.” The court intimated that it regarded the question presented to be of great impor- tance, aside from the amount of property involved, which is considerable. The point in controversy is wuether a child thus acknowledged hasa right to inberit from his father’s brother, the boy’s father having died before bis uncle. *n view of all the circumstances, the court desired to give full scope for argument by counsel. The court tad no knowledge of the ques- tion here oresented ever being decided in this State. It was agreed that briefs shall be sub- mitted and that there shall also be oral argument. To strengthen the claim of the young man Anselmo as an heir to & share of his | uncle's estate the allegation will be vressed that a great share of Vincente's estate was actually inherited from A selmo’s father, and to back up Anselmo’s zht for an inheritance it is pointed out he was recognized in his uncle’s will and accorded a Jiberal bequest, but t as much as he would receive if de- clared an equal heir with the other legatees under the will. rtimation has been made that the legal fight again selmo will include a question of identity, and he will be called on to establish the fact that he is really the child of Vincente de Laveaga’s brother. Depositions of residents of Mexico wilt be taken, as Anselmo was born in that country, where his mother died several years ago. Itis evident that a prolongea struggle for the thousands of dollars has been be- gun, and it may be years before any of the | heirs will be in a position to enjoy the fruits of victory. She de- scribed the island of Unalaska and the habits of those that live on the island; also the beautiiul scenery that greets the eye at_every turn in that region. The poem by Miss Harriet M. Skidmore was well reccived, and she was prevailed upon to read it twice. “The Army Woman’ was discussed at length by Mrs. O'Connell, who wept on to sav that tuere was no more mistaken idea than that garrison life was not one of unalloyed pleasure.
