Ernest McCullough Explains the Value of the Charter Clauses Relating’ to Municipal Ownership. The following communicafion is self- explanatory: ) the Editor of the Call—Sir: Unfortunately gnother attack on the proposed charter has peared in print in the public press. 1t is an aitack on an article from the writer which eppeared in the Examiner last Sunday. In that article the statement was made that it was not necessary for the Board of Public Works to act unanimously in recommending estimates to the Board of Supervisors for the costof building or purchasiug water works or other public utilities. The writer still holds to that opinion for the reason stated—that is, the Board of Public Works is anly an advisory hody when the purchase of such utilities comes up for consideration. It isa body ot trained men who shall assist the Board of Supervisors technical mutiers; their duties are advi- ¢, the Supervisors’ duties are icgislative. To ‘insist that the public utilities cannot be purchased or that the SUpErvisors are not em- powered to submit the question tos vote of the people without the concurrent unanimous opinion of the Board of Public-Works thatthe estimates are correct and reasonsble and the proposed action is right, makes the Board ot Public Works & portion of the Board of Super- visors with equal powers of seemingly & legis- lative character. The individual who takes the ground that the Board of Public Works is thus a part of the Board of Supervisors quotes section 3 of chapter 1o0fa n proof of his missiatements. A portion of said section says “No order or res- olution shell be passed or business transacted involving the approval of bonds, awarding of racts, appointment}of employes, or reso- »ns of iniention recommending work or im- provement, except by the concurrent vote of the Commi i This sec just quoted cennot by any reasonable man pe understood as making it upon the Commissioners to ap- ndatory e the issuance of bonds to purchase water or street railways. It merely refers to section 2 of chapter 1 of article VI preceding, where {t is stated that the Commissioners may require emploves to furnish bonds and that said bonds must be anproved by the Commis- e following section where it requires the concurrent vote of all the Commissicners to approve bonds might lead the ordinary man possessing common sense to believe that the section referred to the bonds of employe spoken of in the preceding section. Some very ordinary men, however, do not seem to ommon sense. Let us examine care- v section 8 of chapter 1 of wherein the duties of the Commissioners of the Board of Public Works are set forth in the matter of municipal ownership. The section in full reads as jollows: It shall ve and is hereby made the especial duty of tne Board of Public Works to prepare, at least three months previous to every City election, en estimateof the value of the various street Tailroads of Sau Francisco; the value of the gas, electric_or other plants or methods for ting said City in all portions, both public and privace, thereof; the water works of said City; the telephones of said City, and all other franchises granted and in use in such City and County. The estimate thus made shall be the basis upon which may be submitied to the | and County the question | electors of said City whether or not said electors desire to purchase such properties, or any of them.” There is nothing in that section which states that the Board ot Public Works shall recom- mend the purchase or that they must act as & unit in submitting the estimates of cost. It is their duty to submit the estimates and, as the writer before stated, the task of meking the estimate is an immense one. In practice it will undoubtedly be arranged between the Commissioners that one of them shall have that especial duty to perform. If his esti- mates do not suil the other Commissioners ey have the privilege of submitting a me- or minority report. It is optional with the Supery 0 submit the question to the people of voting upon the purchase or con- struction of works. Butif the Supervisors do submit the question to the people they must do so upon the estimates submitted by tne Board of Public Works and upon no othe: It is not anywhere stated in the charter that the Board of Public Works must unanimously vote upon the desirability of possesing the works before submitting the guestion 1o the Supervisors or the people. And furthermore, in reference to estimates of cost it is well to Temember that section 64 of chapter 2 of article Il says the estimates of value of existing plants must not exceed the cost of duplicating such plants by construc- tion. The Board of Public Works must submit to the Board of Supervisors the reasonable cost of constructing such works and the Supervisors submit to the people the siternative of con- structing them or of purchasing the present ones. 1f the people decide to purchase the pres- ent works the Supervisors have the power to condemn_and purchase them at the vajua- tion set by the Commissi 1f the ‘*associated better care of themselves than to draw u a clanse like that to insert in the charter they need 1o be taken care of. It puts them where all franchise-owning corporations should be— ut the mercy of the people and in their full power. At present the corporations seem to own San Francisco, according to our friends who object to the cnarter, but when the char- ter is adopted the corporations will be careful not to offend the people as now frequently happens, for it will be possible for the people to Tevoke the privileges granted by the fran- chise and vote to run things themselves.
