TO HOLD A MASS-MEETING The West of Castro Street Improve~ ment Club Hold a Spirited Meeting. The contemplated suit by the Noe hei against the property-owners in that sec- tion of the city known as the San Miguel Rancho, or Noe Valley, as it is commonly called, was discussed at a regular meeting of the West of Castro-street Improvement Club at Judson Hall, on Douglass street, last night. tended and the expressions aeainst the jnstigators of the suit were strong. The speakers and the members of the club who gave expression of approval by their ap- plause are determined in their sentiment against the Noe heirs and declared that they would stand together in the fight, if fight it should be. It was decided to hold 2 mass-meeting of the property-owners affected on n Thursday night at Twin Peaks Hall, cor- ner of Seventeenth and Noe streets, where | the entire community may xpres to their views and organize a specific plan of opposition. WL Curtis, president of the club, called th2 meeting to order and Major M Kinney acted as secretary the execptive cominiitee was called forand George D. Shadburne, chairman of the committee, presented several matters be- fore addressing himself to the subject of the Noe suit. Mr. Shadburne then reported on the aspect of the contemplated suit of the Noe heirs. He reviewed the history of the San Miguel rancho, presenting an’ abstract of the title from Don Jose de Jesus Noe down to the present owners. The origmal Mexi- can grant W 4443.38 acres, or about one league, running from Seventeenth street nearly to the ocean, from Corbett street to San Jose avenue, on the other limit to the county line. Mr. Shadburne said The tract was conveyed by Pio Pico to Jose de Jesus Noe on December 1845. On March 30, 1857, &_patent was issued to him. By an agreement Noe conveyed the property to Charles B. Strode on August 2,1853, and on August 3, 1853, Strode_assigned it_to John M. Horner. Noe then on January 10, 1854, deeded ihe tract to John M. Horner. On February 4, 1854, Horner mortgaged_the property to Cor: nelius K. Garrison for $50,000, and this mort- gage was assigned to Samuel Moss Jr. October On April 3, 1856, the tract was sold 10 Theodore F. Moss for $157,500. Thus Moss became the possessor and & deed followed. On 5, 1856, Moss conveyed by deed to On July 3, 1857, and on Fel mense land excitement here consequent on the opening of the Central Pacific Rail- road. This land advanced thousands of dollars in value. Men bought property without seeing it, realizing hundreds of thousands of dollars. Under the Noe Gar. den Homestead Union this land was dis—‘ tributed. He continued: The title I have thus traced issimple and | plain, and does mot_require the interpretation of alawyer, and after_holding this property directly from Jose de Jesus Noe for forty-one years, it is too late for any man to lay claim to it. But within the past few days it has been stated that a suit is about to be brought by the Noe heirs. The time that has elapsed co the lives of two minor heirs, and according to | § law it cannot now be recovered. The claims of these heirs, through their attorneys, as presented in Tue CALL of the 13th and 14th insts., were reviewed by Mr. | Shadburne and he then addressed the meeting on the necessity of a united senti- ment on the vart of the nearly 10,000 roperty-owners in defense of their homes. Mr. Shadburne then read an editoriai on the subject of this suit which appeared in TxE CALL on the 17th inst., and compli- mented THE of the property-owners of the San Miguel rancho district. He continued: 1 hope no man or woman affected by this suit will be frightened by itand that they will stand | by their homes and, if necessary, defend them with their live: Major McKinney spoke to the subject, saying he thought that forty years’ pos- gession was enough to give the property- owners courage to stand by their rights. Messrs. Collins and Judson and others spoke, expressing the opinion that this suit was merely a game of bluff and would not win. President Curtiss stated that one of the best evidences of the legality of the titles to the land was found in the fact that within the past few days loans had been placed on propertv in that section to the aggregate amount of more than $20,000. “The banks,” said Mr. Curtiss. “‘are good enough not be disturbed.”” He thought there was no likelihood of any sensible banker loan- ing money on land the title to which was clouded. After consideration of other minor mat- ters the club adjourned to the mass- meeting next Thursday night. TO RECOVER A WIFE. L. H. Cosper Is Suing to Have His Di- : vorce Set Aside by the Court. Dsisy E. Cosper obtained a divorce from L. H. Cosper about a month ago, alleging failure to provide, and now the busband is suing to have the case retried. He sayshe did not receive notice of the hearing before. Numerous witnesses, among them Mrs, Viola Trist, John Quincy Adams, E. A. McDonald and Mrs. Lulu Horton, were called yesterday to give evidence that Mr. Cosper was at all times a model husband, and that he never failed to provide. Mrs. Trist is the young man’s recent mother-in-law, and she was not prepared to recommend Mr. Cosper as a model hus- band, but there were some particulars about the family support that the defense wanted to bring out. Several of the witnesscs stated Mr. Cos- per was as good a husband as any man ought to be, and that he even stayed at home alone nights to take care of the baby. . This baby was an object of contention, it appeared, from the fact that it was named for an old lover of Mrs. Cosper. This man’s name was Frank, and so was the baby’s name until Mr. Cosper took a dislike to the old friend of Mrs. Cosper. Then the father gave a new name to the baby, while Mrs. Cosper and her mother adhered to the old one. Mr. Cosper, it was stated, provided everything for the family support except Iei ';l‘ne pie was provided by the mother- n-law.
