THE BEE: YIRWS OF OTHER ROADS ON RATE CASE Union Pacific Says Not Contemplat- ing Suit Now and Has Done Nothing, RELY ON INTERSTATE SUIT Among railroad attorneys the holding of the federa] judges in the Missouri Pacific case, permitting that rallroad company to advance its pas- senger rates in Nebraska from 2 to 2 cents per mile and restraining the Btate Rallway commission from in- terfering in such advance, s the toplo for discussion. All of the rail- road attorneys are with the court in the holding, but none is ready to say what action will be taken by the roads they represent, looking to a suit to sgeure a similar ruling. Byron Clark, general attorney for Nebraska for the Burlington, said: | “So far as we are concerned, no action | has been taken. We are awaiting the! outcome of a complaint before the Inter- ! state Commerce commission. Before the | commission the 2-cent per mile proposi- | tion 1a to be determined, it applying to As A. McLaughlin, general attorney for the Northwestern for the lines west of the Missouri river, sald: “With considerable interest we have watohed the Missourl Pacific case, but have done nothing looking to the com- mencement of a similar action in the Nebraska courts relstive to passenger rates. I don't know as we will, for it is probable that the whole rate question will be settied by the decision of a case ghat fs before the Interstate Commerce commission.| In that case the entire ques- tion is raised and the finding of the court will probably apply in all states in which we operate.” Sald Edson Rich, general attorney for the Union Pacific in Nebraska: ““While we have felt an interest in the outcome of the Missouri Pacific case, we have donme nothing looking to having the Nebraska rates declared vold so far as applying to the Union Pacific Is con- cerned. At this time we are not contem- plaiing & suit.” Yeiser Attacks Law Permitting Wage Garnishment Garnishment of 10 per cent of laboring men's wages in cases where the sum | recovered does not amount to more than ' the costs in justice court, is threatened in & suit filed In district coBrt by Henry Olgen in which Dr. Charles Luber and Justice Vincent C.
