QUIETUS ON BILLBOARD LAW ORDERED BY JUDGE ESTELLE Restraining Order Granted Three Years Ago Becomes Injunction by Ruling of District Court. A temporary Injunction issued by district court now stands against the billboard ordinance passed three vears ago by the oty council and which was Immediately put to sleep by a restraining order. Judge Estelle has handed down a de- cision which nullifies the ordinance as it stands, because of several provisions held to be unreasonable. Other nrestrictions against billboards are declared perfectly valid and Assistant City Attorney Dunn, who has had charge of the old ordinance case, will draw up a new one in accordance of. the court. asserts in his opinion that the city has a right to regulate billboards as to helght and general construction and holds that the limit of eleven feet as pro- vided in the enjoined ordinence is not un- reasonable. It would be less arbitrary, nevertheless, says the court, If qualifications as to helght were made to conform to the ordinary unit system of billboard construe- tion. But the city, declared Judge Estelle, has no right to say that billboards must be twelve feet or ten feet or any other dis- tance from the lot line and boardings may be erected. if desired, exactly upon the sidewalk line. Nor has the city a right to prescribe a gap of twelve feet from the end of the boarding to adjacent bullding. The street department is badly in need of a service building at some central point, but until some way can be found to provide the necessary lot and money for bullding the extra material will be stored, probably at the asphalt plant. The fight between former Mayor Tom Hoctor of South Omaha and that city over the bullding of Hoctor boulevard has be- come so sharp that it finds itself in fed- eral court. The General Construction com- pany engaged to bulld the road has ob- tained a temporary restraining order to prevent the eity councll of South Omaha from repealing the ordinance authorizing the construction of this street.
