Bellinger Will Ride Free. “Well, it doa't matter much who troduced it replied Councilman Bel inger, 1 Intend 1o ride on iy pass and I don't care who knows it. Law or no law, 1 intend to use it until I am shown that it is illegal. If any of the members of the council want to proceed against me y can and the sooner the better 50 far as 1 am concerned.” “If the ordinance is not good the passes are not good,” insisted Counciiman Jen- | sen. and in this view of the controversy he | was supported by City Solicitor Kimball. | Further, Mr. Kimball argued that even if | the passes were legal, the counciiman cculd legally ride on them only when on city businese and on only such sircets as | the franchise covered. He contended that | the passes were not good on Avenue A, Bicadway or 10 Omaha as these sireets | were not included in the ordinance under | which the company gave the passes. Having disposed of the matter of the passes the councilmen turned their atten- | |tion to the street railway company and its | tailure to bring its tracks to grade on Avenue A. Councilman Rigdon wanted the matter referred to the committee of the whole, but the other councilmen would not listen to this. The city solicitor was, {after a prolonged discussion, instructed to | bring the mandamus suit against the com- pany in time for the January term of dis- trict court, s the action could be dis- missed at any time in the event of the {company and the city coming to an lamicable arrangement. At the suggestion of Councilman Rigden | the mayor will appoint & committee of | three o confer with the attorney and gen- eral manager of the street railw.y com-| pany, and the Commercial club will be | asked to appoint a llke committee to as- | sist the city in the negotiations with the company.
