It is alleged that the city has been over- rug with venders of impure milk and that parties engaged In this business have grown bold for the reason that the numer- ous cases which have been fustituted in the 'police court against them and then appealed have never come to a trial after- wards. For this reason the alleged vio- lators of the law as regards the vending of impure milk have, it is sald, continded their nefarious business until a prosecution was dremed an absolute uecessity. Carl Jensen had been before the police Judge on the charge of dealing in impuro milk and his case had been appealed to the district court. Upon sssuming the du- ties of his office as ocity prosecutor and after having informed himself of the ex- isting_conditions relative to these cases; City Prosecutor Thomas F. Lee resolved that the cases should be pushed, and the first alleged offender happened to be Carl Jensen. When it was found that the prose- cution had made good its claim that it would push the matter before the distyiot court Mr. Jensen paid his fine of $20 and costs, and thus the first of numerous sim- flar oases to be argued before the district court was disposed of. It 18 expected that the trial of similar cases will occupy the district court for at least teh days. The city officials have re- solved that the violators of the law regu- lating the sale of milk shall be punished. About fifty old cases which had been on the abpeal docket of the city prosecutor have been outlawed, as they date from 1899, but Mr. Lee has cleaned the docket up to the time of his assumption of the dulles of the office and will prosecute sach and aN of the appeal cases which have been made since he assumed the office. The court, after listening to the presentation of both sides of the ease, entered & plea of not gullty and ap- pointed Attorney T. J. Mahoney to make an independent investigation of the charges previcusly preferred against the lad and al- leging grand larceny, and report his find- ings to the court. The lad's father” appeared in the court room and testified as to the misdemeanors of his son. It was alleged by the father that his sen had stolen $% from him re- cently. The particular crime of which young Swanson had been charged was the theft of A policeman entered young Bwanson's rooms and recovered the M and secursd & confession from the boy. This confession was given voluntarily and the youth did not seem to want to hide the fact that he had taken the money. He said he had taken it in order that he might as- sist his father. ‘When arralgned before Judge Estelle the lad sald he had but recently returned from an extended trip covering Milwaukee, Den- ver, Kansas City and other points. At this point Mr. Swanson interrupted to say that he had no home for the boy, as he had lost his mother some time ago, and then It was that Judge Estelle gave expression to his compassionate utterance.
