10 DAILY BEE: AUGUST PREPARING FOR MANY SUITS Owners of Oollapsed Douglas Btreet Build- ings Going to Oourts for Relief GROCER HUGHES WILL ALSO ASK DAMAGES Will Not Comdemn a—Prospect for uded Inspector Withnel! Adjoining Build New Hlock on Site by Leases. A fence has been built out into Douglas #treet surrounding the ruins of the ool- Japsed bufldings No. 1408 and No. 1406, but it is stated that the old brick and other refuse will be moved befors Christmas. 8o far as rebullding is concerned every- thing i still “up in the air” and the only cortain result of the falllng down of the two old bufldings is that a number of suits will be flled in the district court as soon as the lawyers can draw up the mecessary papers. H. J. Hughes has retained Hall & Mo~ Culloch and will bring a damage suit Bgainst the Western Real Bstate trustees of Boston, owners of the bullding 1406 Douglas, for the value of his stock and fixtures and other damage sustained by him. A. J. Hanscom, it is stated, will also bring suit against the same parties for the walue of the bullding, No. 1408 Douglas, Bnd the loss sustalned through its falling down. Representatives of the Western Real Es- tate Trustees are elso preparing to bring suit against A. J. Hansoom. Whether or mot H. J. Hughes will be included in this sult has not yet been determined. Btill another suit which may:grow out of the matter s one by A. J. Hanscom against H. J. Hughes. Allegntions in Petitions. The main allegation in the first set of wuits will be that the destruction of the bullding, No. 1408 Douglas, and the stock and fixtures in it was caused by the alter- ations in progress to the bullding No. 1406 Douglas. The main allegation in the other set of suits will be that the falling of the two buildings was caused by the disintegration and undermining of the party wall between them, such disintegration and undermining being caused by water which dripped onto &nd through # from an ice box in the gro- cery store in 1408 Douglas. Soveral old-timers who remember when the upper stories were put on the buildings twenly years ago say that plenty of tea- timony can be obtained by both sides to the effect that the bulldings have been consid- ered unsafe for years, and that when the upper storfes were placed on them many remarked that the walls were not strong enough to bear the added weight. Bullding Inspector Withnell has not yet officially dons any condemning, and states that the two-story brick on the corner, oc- cupled by a pawnshop, tobacco and news store, with lodging rooms above, is not serfously injured, and will be allowed to stand. Willing to. Bufld, Frank B. Kennard, owner of the corner building, states that he would strenuously contest any condemning of the bullding by the city, but that he is perfectly wiling to tear it down and join the owners of the lots to the west in putting up a substan- tial block, with store rooms below and of- floe rooms on the upper floors. The only obstacle in the way of doing this, so far @s he is concerned, Mr. Kennard says, is that M. Brodkey has a iease on the build- ing which does not expire until June 15, 1004, and which contain & provision for an axtension of the lease for twenty months. The Kennard lot is 106 feet 9 inches on Wourteenth and 22 feet on Douglas. The Hanscom, Western Real Hstate Trustees and Horbach lots to the west are each 2% foet on Douglas and run back 132 feet to the alley. Mr. Kennard will suggest to the other owners the erection of a three-story buflding, of substantial construction, hand- some in appearance and strictly modern. B. J. Bullivan, agent for the bullding No, T Douglas, states that he has the assur- gnoe of Bullding Inspector Withnell that it will not be condemned, and that as soon as the overhanging wall 1s removed it can be qccupled. The owners of the bullding, who have a long time lease on the ground, will very willingly, he says, sell out at a low figure to anyone desiring to build, but are not disposed to do any bullding on the lot.
