Bight of the cases were brought before Judge Phillips on March 2¢, when a bill WAs presented by the government at the instance of the Interstate Commerce com- mission and a temporary restraining order entered witheut grgument. A similar blll was brought betore Judge Grosscup against the other six roads and & like order entered. The rallroads against whom the injunc- tion {s asked are: Michigan Central, Pitts- burg & Fort Wayne; Pittsburg, Cinolanati, Chicago & St. Louls, Lake Shore & Michi- gan Southern, 1llinols Central and the Chi- cago and Northwestern, affected by Judge Grosscups’ order. Chicago & Alton, CM- cago, Milwaukee & 8t. Paul, COhloago Great Western, Atchison, Topeka & Santa Fe, Chicago, Rock Island & Pacifie, Chi- cago, Burlington & Quincy, Missour! Pa- cific and the Wabash against which Judge Philips order was operative. Special Attorney W. A. Day presented the government's case, while Attorneys J. M. Dickinson of the Illinois Central and Robert Dunlap of the Santa Fe argued for the rail- road ‘The hearing of the fourteen cakes in Chi- cago simultaneously {s by agreement of counsel. Dickinson Opposes Motion, Mr. Dickinson, general counsel of the Tllinois Central, took up most of the after- noon. He first pointed out what he con- sldered an important omission from the government bills of declaration, declaring there was no allegation of diecrimination as to rates on packing house products, while there were such allegations as to grain rates. “If an injunction can issue on such alle- gations,” he said, “then a new chapter in American jurisprudence must be written." The declsion in the Debs case was fre- quently referred to, Mr. Diekinson claim- ing that the ruling made (n that case was extraordinary and suited to extraord- inary orisls, but he insisted the applica- tion of the decision should not be made commonplace. At one point Judge Grosscup interrupted the argument by asking: “If (he majority of shippers along a cer- tain line of raflway = are disériminated agalnst and driven out of business, are not the hundreds of farmers algng the same line injured by having to sell their pro- ducts to only one purchaser?”" “That point seems to le outside this bill," said Mr, Dickinson, “though I admit the wrong is sufficiently set forth as to grain shippers.” “But who can assert the right of all these farmers if not the government under the interstate commerce act?” asked Judge Grosscup. “They can assert it themselves reply. “Is not that the ground upen which the government interferes? Does not the at- torney general ask injunctions so that all these individuals will not be ecompelled to bring separate actions inquired Judge Grosscup. Mr. Dickinson did not wer directly. “That is the question that will have to be adjudicated,” he said.
